La ley establece la obligatoriedad del registro de las armas de todas las instituciones del Estado, haciendo énfasis en las del Ministerio de Gobernación; pero también es clara en dejar fuera del proceso del registro a las del Ejército. Eventos recientes evidenciaron que los controles dentro del Ejército distan de ser infalibles.

La ley guatemalteca obliga a la toma de huella correspondiente… No obstante, la ley no previó la obligatoriedad de llevar un registro de la huella balística de las armas incautadas que hubieren sido utilizadas en hechos criminales. Relevant Aspects of the Decree 15-2009

According to the Law it is compulsory to register all State-owned firearms, particulary those held by the Ministry of the Interior. However, it is also clear that arms held by the Army are not included in the registration process. Recent events have shown that the the Army's firearm controls are far from infallible.

Guatemalan Law made it compulsory to employ ballistic fingerprinting… However, the Law did not include a provision making it mandatory to keep the ballistic fingerprint of the seized firearms which may have been used in criminal acts. This means that ballistic comparison can only be made against legal firearms…
