Article 16. Les contrevenants aux dispositions du présent décret seront passibles des peines suivantes :

a) un emprisonnement allant jusqu'à trois (3) ans et une amende de cinq-mille gourdes (5 000,00 Gde) pour les armes de poing, les fusils et revolvers à air comprimé;

b) un emprisonnement allant jusqu'a cinq (5) ans et une amende de dix-mille gourdes (10 000,00 Gde) pour les armes d'épaules ou fusils de calibre 12, 16, 20, 410 Ga;

c) un emprisonnement allant jusqu'à dix (10) ans et une amende de soixante-quinze mille gourdes (75 000,00 Gde) pour les armes automatiques et munitions correspondantes;

d) un emprisonnement allant jusqu'à quinze (15) ans et une amende de cent vingt-cinq mille gourdes (125 000,00 Gde) pour la possession d'engins destructeurs ainsi que l'importation et la vente d'armes de tous types et de toutes catégories.

Ces sanctions seront à la diligence du ministère public, prononcées par le tribunal correctionnel toutes affaires cessantes sans remise ni tour de rôle sur le vu du procès-verbal dressé par les Forces armées d'Haïti.

Decree of 23 May 1989, Modifying Certain Articles of the Decree of 12 January 1988, on the Control of Firearms, Ammunition, Explosives and Other Categories of Weapons on the National Territory

Article 16. Anyone infringing provisions of this Decree shall be liable to the following penalties:

a) a prison term of up to three (3) years and a fine of five thousand Gourdes (5,000.00 HTG) for air-handguns, air-rifles and air-revolvers;

b) a prison term of up to five (5) years and a fine of ten thousand Gourdes (10,000.00 HTG) for long guns or rifles of calibre .12, .16, .20, .410;

c) a prison term of up to ten (10) years and a fine of seventy-five thousand Gourdes (75,000.00 HTG) for automatic firearms and their ammunition;

d) a prison term of up to fifteen (15) years and a fine of a hundred twenty-five thousand Gourdes (125,000.00 HTG) for the possession of destructive weapons, as well as for the import and sale of firearms of any type and any category.

These penalties shall be at the behest of the public prosecutor, ordered by the Criminal Court, which shall be addressed head on and without postponement nor putting back the case on the list considering the minutes prepared by Haiti Armed Forces.
