ii) ¿Son las marcas únicas y exclusivas? (PA, II.7)

En Colombia se utiliza un código alfanumérico. El método de marcaje debe ser autónomo del país, sin embargo se debe garantizar el cumplimiento de unos criterios mínimos tales como, permanencia, durabilidad e indelebilidad y uniformidad, para un mejor control.

La marcación de las armas, municiones y explosivos en Colombia si es requerida por disposición legal, Ley 737 de 2002, las normas ISO 9000 y 9001 y los procedimientos internos implementados para dar cumplimiento a lo exigido en las normas legales.

1. Armas

a - Para las fabricadas por la Industria Militar, consiste en estampar la sigla INDUMIL (IM) calibre y número consecutivo.

b - Para las armas importadas por la Industria Militar, se le exige al fabricante de las mismas que estén debidamente marcadas y numeradas. Una vez se realiza el trámite de legalización en la Aduana, se reciben por el almacén general por medio del acta donde se registra el número de cada una de ellas. Las armas se dan de alta y se remiten a los diferentes almacenes comerciales de la Industria Militar, donde se registran en un libro interno. Una vez se comercializan, al cliente se le entrega un documento denominado "valor uso" donde se registra la entrega del arma respectiva, además del permiso de uso (porte y tenencia) expedido por el Departamento de Control y Comercio de Armas o por la seccional de control de armas en cada jurisdicción.

2. Municiones

Para la munición de defensa personal y cacería se estampa en el culote del cartucho: la sigla INDUMIL y el calibre; en la caja se marca un consecutivo de ocho dígitos, los dos primeros indican el año de fabricación.

Marking, Record-keeping and Tracing

In Colombia an alphanumeric code is used. The method of marking should be autonomous to the country; but it must ensure compliance with minimum standards for better control, such as durability and uniformity.

The marking of weapons, ammunition and explosives in Colombia is required by law, Act 737 of 2002. Standards ISO 9000 and 9001 and the internal procedures were implemented to comply with the regulation requirements.

1.Weapons

a - Those made by the Military Industry are stamped with the acronym INDUMIL (IM), the calibre and the consecutive number.

b - For the weapons imported by the Military Industry, the manufacturer is required to properly mark and number [their weapons]. Once the legal process is carried out by Customs, they are received by the general store which records the number of each weapon. The weapons are discharged and sent to the various Military Industry stores, which are recorded in an internal book. Once sold, the customer is given a document called "user value" which has the respective weapon delivery, as well as the permission to use (size and tenure) issued by the Department of Arms Control and Trade or the sectional arms control of each jurisdiction.

2. Ammunition
For ammunition used for personal defence and for hunting, stamped on the bottom of the cartridge is the acronym INDUMIL and calibre. A row of eight digits are marked on the box: the first two indicate the year of manufacture.
