En el Código Penal de la República de Cuba se contempla como figura delictiva la fabricación, posesión, almacenamiento y comercio ilícito de armas pequeñas y ligeras de la siguiente forma:

- Artículo 211.1. El que sin autorización legal adquiera, porte o tenga en su poder un arma de fuego sin licencia o permiso de la autoridad competente, atendiendo a que son armas para las cuales se concede licencia, incurre en sanción de privación de libertad de 2 a 5 años.

- Artículo 211.2. Si el hecho consiste en fabricar, vender o de cualquier forma facilitar a otro un arma de fuego, la sanción es de privación de libertad de 3 a 8 años.

- Artículo 211.3. Cuando se trate de una categoría de arma de fuego de clase para la que no se concede licencia, la sanción es de privación de libertad de 3 a 8 años, por el Artículo 212.1 1; y de privación de libertad de 4 a 10 años por el Artículo 212.2.

- Artículo 212.1. Se sanciona a privación de libertad de 6 meses a 2 años o multa de 200 a 500 cuotas, al que poseyendo licencia o autorización legal para portar armas de fuego:
a) la porte en un lugar u oportunidad en que se halle prohibido por disposición del órgano estatal competente;
b) preste o de cualquier modo procure a otro dicha arma.

- Artículo 212.2. En los casos previstos en el apartado anterior (212.1) se impone, como sanción accesoria, el decomiso del arma.

The manufacture, possession, storage and illicit trade of small arms and light weapons are considered offences by the Criminal Code of the Republic of Cuba:

- Article 211.1. Anyone who illegally acquires, carries or has in his possession a firearm without a licence or permit from the competent authority, provided that the weapon in question is one for which a licence can be granted, shall be punishable by two to five years' imprisonment.

– Article 211.2. If the offence consists of the manufacture or sale of a firearm or in assisting another individual in any way to obtain a firearm, the penalty is three to eight years' imprisonment.

– Article 211.3. In the case of a type of firearm for which no licence can be granted, the penalty is
a) three to eight years' imprisonment for an offence under article 212.1 1
b) four to ten years' imprisonment for an offence under article 212.2.

– Article 212.1. Anyone possessing a licence or legal authorisation to carry firearms may be sentenced to six months' to two years' imprisonment or a fine of 200 to 500 days' wages if:
(a) He carries that weapon in a location or on an occasion where carrying a firearm is prohibited by the competent State authority;
(b) He lends or in any manner transfers that weapon to another person.

– Article 212.2. In the cases described in paragraph 212.1 above, as an additional penalty, the weapon shall be confiscated.
