Artículo 78 - Incautación de armas de fuego, municiones, explosivos y afines

La incautación procede en todos los casos en que las armas de fuego, municiones, explosivos, accesorios y afines se encontraren en violación a los requisitos establecidos en esta Ley.

La autoridad que incaute está obligada a entregar a su poseedor un recibo en el que conste: lugar y fecha, característica y cantidad de elementos incautados (clase, marca, calibre, número y estado), nombres y apellidos, número de documento de identidad y domicilio de la persona a quien se le incautó, cantidad de cartuchos, y otros elementos incautados, número y fecha de vencimiento del permiso, unidad que hizo la incautación, motivo de ésta y firma de la autoridad que la realizó.

La autoridad que realizó la incautación remitirá a la autoridad competente todos los materiales incautados acompañados del informe correspondiente dentro del plazo de setenta y dos horas. Los Comandantes de Naves y Aeronaves remitirán los materiales incautados y el informe pertinente cuando arriben a puerto o terminal nacional.

El incumplimiento de lo dispuesto en este artículo por parte de la autoridad actuante será considerado como causal de mala conducta para los efectos disciplinarios, sin perjuicio de las sanciones que por otras leyes correspondan aplicar.

Article 78 - Seizure of Firearms, Ammunition, Explosives, and Similar Items

Seizures occur in all cases where firearms, ammunition, explosives, accessories and similar items are found to violate the requirements established in this Act.

The authority that is in charge of seizing firearms is obliged to deliver a receipt to the holder stating the following: place and date, the features and amount seized (class, brand, calibre, number and condition), name and surname, identification number and address of the person whose firearm was seized, number of cartridges and other seized items, number and expiration date of the permit, the unit [department or authority] that made the seizure, the reason for the seizure taking place, and the signature of the authority that is responsible for seizing the firearm.

The authority that conducted the seizure will forward all materials seized, accompanied by the corresponding report, to the competent authority within seventy-two hours. Ship and aircraft commanders will submit the seized materials and their report once they arrive at the port or national terminal.

Failure to comply with the provisions established in this article by the acting authority could lead to penalties under the law.
