Artículo 78. Clases de Licencias

A los efectos del presente Decreto-Ley, se establecen seis clases de licencias de armas de fuego.

De Primera Clase: Para la tenencia, porte, uso y transportación en todo el territorio nacional, de un revólver o pistola, destinados a la defensa personal, por parte de aquellas personas naturales, que por su responsabilidad, cargo y desempeño de sus funciones lo requieran o que por sus condiciones políticas, morales y sociales se autoricen por el Ministerio del Interior.
Solamente se puede inscribir en esta licencia un (1) arma de fuego (revólver o pistola), cuyo cañón no sobrepase los 13 centímetros y cuya longitud total no exceda de 28 centímetros.

De Segunda Clase: Para el porte, uso y transportación de armas de fuego (pistolas, revólveres y escopetas) durante la prestación del Servicio de Seguridad y Protección de Bienes y Personas, por parte de los Agentes de Seguridad y Protección, Detectives y Escoltas, pertenecientes a Empresas y Agencias de Seguridad y Protección, así como los Agentes de Seguridad y Protección de órganos, organismos, organizaciones y entidades con Grupos de Seguridad Interna.

De Tercera Clase: Para la tenencia, porte, uso y transportación por personas naturales, de armas de fuego no estriadas (escopetas con un largo de cañón de 45 hasta 76 centímetros), en los lugares destinados al deporte de la caza por el organismo facultado.

De Cuarta Clase: Para la tenencia, porte, uso y transportación de armas de fuego (fusiles, escopetas, pistolas y revólveres) destinadas a la práctica y competencia del tiro deportivo, por las personas naturales, en los lugares autorizados por el Ministerio del Interior.

De Quinta Clase: Para la tenencia, porte, uso y transportación de armas destinadas al deporte de la caza, práctica y competencia del tiro deportivo, protección ante el peligro aviario y afectaciones aviarias, para uso veterinario y actividades científicas u otras actividades, por personas jurídicas nacionales, en correspondencia con los requisitos y regulaciones que establezca el Ministerio del Interior.

De Sexta Clase: Para la conservación y colección por las personas naturales o jurídicas, de las armas de fuego que constituyan rarezas o presenten valor histórico, científico, artístico y de aquellas que tengan valor sentimental como recuerdo por las personas naturales, en correspondencia con los requisitos y regulaciones que establezca el Ministerio del Interior.

Article 78. Types of Licences

Under the effects of the present Decree-Law, six types of firearm licences are established:

First class: for owning, carrying, using, and transporting across the national territory, a revolver or gun, destined for personal defence, requested by natural persons on account of their responsibility, duties, and services, or for their political, moral, and social conditions authorised by the Ministry of the Interior.
Only one (1) firearm (revolver or gun) can be registered as part of the licence, and the barrel cannot be longer than 13 centimetres while the total length [of the weapon] cannot exceed 28 centimetres.

Second class: for carrying, using and transporting firearms (guns, revolvers and shotguns) during activities by the Security Services and Protection of Goods and Persons by Security and Protection agents, detectives and security escorts that belong to Security and Protection companies, as well as Protection and Security agents belonging to bodies, agencies, organisations and entities that belong to Internal Security Groups.

Third class: natural persons owning, carrying, using, and transporting non-rifled firearms (shotguns with a barrel between 45 to 76 centimetres) in places destined for hunting by the authorised agencies.

Fourth class: natural persons owning, carrying, using and transporting firearms (rifles, shotguns, guns and revolvers) that are destined to be used for practicing sports shooting in places authorised by the Ministry of the Interior.

Fifth class: owning, carrying, using and transporting arms destined for hunting, practicing sports shooting, protection against damages caused by birds, veterinary use, scientific activities and other tasks by national legal persons in accordance with the requirements and regulations established by the Ministry of the Interior.

Sixth Class: for the preservation and collection by natural or legal persons of firearms of rare or historical, scientific and artistic value, and those that may possess sentimental value, in accordance with the requirements and regulations established by the Ministry of the Interior.
