Artículo 37. Prohibiciones

En aplicación de la presente Ley, quedan prohibidas y por tanto pasibles de sanción las siguientes conductas, aunque los infractores cuenten con licencia de uso:

a) Fabricar, exportar, importar, comercializar, transportar y transferir armas nuevas o de segundo uso, municiones y materiales relacionados, sin la debida autorización de la SUCAMEC.
b) Efectuar modificaciones o eliminar las características que identifiquen las armas, sin la autorización de la SUCAMEC.
c) Efectuar modificaciones en las armas que alteren la cadencia, el calibre o la potencia.
d) Portar y/o usar armas de fuego en situaciones que generen la alteración del orden público.
e) Portar armas de fuego bajo el consumo de alcohol o bajo los efectos de sustancias estupefacientes o psicotrópicas.
f) Portar armas de fuego en manifestaciones públicas, espectáculos con afluencia de público y centros de esparcimiento.
g) Poseer o usar armas sin la licencia o sin la tarjeta de propiedad respectivas o con licencia vencida.
h) Usar un arma distinta a la autorizada por la tarjeta de propiedad y licencia.
i) Dar al arma de fuego un uso distinto al autorizado.
j) Portar y usar armas de colección, salvo los casos previstos en el artículo 18, numeral 18.3, de la presente Ley.
k) Poseer o usar armas de fuego y municiones prohibidas por la Ley.
l) Poseer o usar municiones en cantidades superiores a las establecidas en el reglamento de la presente Ley.
m) Usar silenciadores y dispositivos que alteren u oculten la apariencia o funcionamiento de las armas, excepto en armas destinadas para caza.
n) Usar miras telescópicas, excepto en armas destinadas para caza, deporte y a las armas distintas a las de fuego.
ñ) Usar dispositivos láser, miras infrarrojas y dispositivos de visión nocturna en las armas de fuego, excepto para armas destinadas para caza o deporte.
o) Utilizar armas o municiones como garantía mobiliaria o entregarlas en depósito.
p) Utilizar en las armas de defensa personal y de seguridad y vigilancia armada municiones con núcleo de acero perforante, de blindaje, trazadoras incendiarias y explosivas.
q) Exhibir armas sin el mecanismo de cierre o disparo desactivado en los establecimientos autorizados para comercialización.
r) Emitir doble comprobante de pago respecto de un arma.
s) No cumplir con las obligaciones legales establecidas por el Ministerio de Salud y la SUCAMEC para los establecimientos de salud que emitan certificados de salud mental para la obtención de la licencia de uso de armas de fuego, conforme a lo establecido en el reglamento de la presente Ley.
t) Transferir o vender armas con licencia para ingreso temporal al país.

Article 37. Prohibitions

Under the present Act, the following conducts are prohibited, and thus subject to possible punishment, even when those responsible may count on a corresponding licence:

a) Manufacture, export, import, trade, transport and transfer new or second-hand arms, ammunition and related materials, without the authorisation of SUCAMEC.
b) Carry out modifications or erase the features identifying the arms, without the authorisation of SUCAMEC.
c) Carry out modifications that alter the rate of fire or power of the arms.
d) To carry and/or use firearms in situations that generate public disorder.
e) To carry firearms under the effects of alcohol or narcotics and psychotropic substances.
f) To carry firearms to public events, shows and amusement areas.
g) To own or use arms without the licence or the ownership certificate, or with an expired licence.
h) To use a different arm from the one authorised by the ownership certificate and licence.
i) To use a firearm for a purpose different from the one it was authorised for.
j) To carry and use collectable arms, except in the circumstances described under article 18, paragraph 18.3, of the present Act.
k) To own or use firearms and ammunition prohibited by the Act.
l) To own or use ammunition in quantities in excess of those established in the regulation of the present Act.
m) To use silencers and devices that may alter or obscure the features and function of the arms, except when these are arms intended for hunting purposes.
n) To use telescopic sights, except for arms intended for hunting, sports and arms distinguished from firearms.
nbis) To use laser devices, infra-red sights and night-vision devices in firearms, except for arms intended for hunting or sports.
o) Use arms or ammunition as a goods guarantee, or hand-over to a deposit.
p) Use in firearms for personal defence, and armed security and surveillance, ammunition with an armour-piercing steel core, inflammable and explosive tracing bullets.
q) Exhibition of firearms without the safety mechanism or with the latter deactivated in establishments authorised for their commerce.
r) To issue a double proof of payment for an arm.
s) Not to comply with legal requirements established by the Ministry of Health and SUCAMEC for health establishments which issue mental health certificates for the grant of firearm licences, in accordance with what is established in the regulation of the present Act.
t) Transfer or sell arms with a licence for temporary entry into the country.
