Artículo 38. Incautación y Decomiso

El incumplimiento de las disposiciones contenidas en la presente Ley da lugar a la incautación conforme a lo establecido en el artículo 218 del Código Procesal Penal o decomiso de las armas, municiones y materiales relacionados, por parte de la SUCAMEC o de la Policía Nacional del Perú, las mismas que deben ser remitidas a la SUCAMEC; sin perjuicio de la presentación de la denuncia penal ante el Ministerio Público, para que promueva las acciones judiciales que correspondan.

Article 38. Confiscation and Seizure

Failure to comply with the regulations of the present Act leads to the confiscation, in accordance with article 218 of the Criminal Procedure Code, or seizure of the firearms, ammunition and related materials by the SUCAMEC or Peru National Police, the firearms having to be handed over to SUCAMEC; notwithstanding penal prosecution before the Public Ministry which shall carry out necessary legal actions.
