Artículo 88. Armas de Fuego Utilizadas en Infracciones Penales

Las armas de fuego utilizadas en el cometimiento de infracciones penales, serán incautadas y remitidas a la Dirección de Logística del Comando Conjunto, luego de las diligencias judiciales realizadas, por los jueces, aún cuando el poseedor hubiere obtenido el permiso para portarlas; y solo podrán ser devueltas cuando exista sobreseimiento o sentencia absolutoria a favor del acusado. Las autoridades militares, judiciales y de policía que en el cumplimiento de sus funciones encontraren en el lugar armas, municiones, explosivos o accesorios, sin la documentación legal que justifique su tenencia o en cantidades superiores a las permitidas por este Reglamento, extenderán la correspondiente acta de decomiso, según formato "M", y ordenarán la remisión de las especies a la Dirección de Logística del Comando Conjunto de las Fuerzas Armadas.

Article 88. Firearms Used to Commit a Crime

Firearms used for penal infringements shall be seized and remitted to the Logistics Direction of the Joint Command, after the prosecutions carried out by judges, even if the owner had obtained a licence to carry firearms, and shall only be returned in the event of a dismissal or acquittal in favour of the accused. All military, judicial and police authorities which, in the exercise of their duties, find firearms, ammunition, explosives or accessories without the relevant legal documentation that justifies their ownership or in quantities larger than those permitted by this Regulation, shall carry out the confiscation procedure in accordance with form "M", and shall order the remittance of those items to the Logistics Direction of the Joint Command of the Armed Forces.
