Decomiso de Armas sin Licencia

Artículo 56. Toda arma no prohibida cuyo tenedor carezca de permiso, será decomisada y deberá de remitirse de inmediato a la Jefatura Departamental de la Policía Preventiva, quien la devolverá al propietario hasta que se efectué el análisis comparativo por el Registro Nacional de Armas y cumpla con los demás requisitos establecidos en la Ley y su Reglamento.

Para el caso de armas utilizadas en hechos delictivos y a la orden de Juez competente, se estará a lo dispuesto en el Código Procesal Penal.

La Secretaría de Estado en el Despacho de Seguridad, podrá ordenar la destrucción de armas decomisadas en caso de deterioro o extrema peligrosidad.

Seizure of Firearms Without a Licence

Article 56. All non-prohibited weapons belonging to owners who do not have a licence shall be seized and immediately submitted to Police headquarters. They shall be returned to the owner once a comparative analysis has been carried out by the National Register of Firearms, meeting all the requirements established by the Act and its regulations.

Firearms used in crimes shall be governed by provisions of the criminal procedure code.

The Office of the Secretariat of Security [National Police] may order the destruction of firearms in cases where they are damaged or pose serious danger.
