Le Décret Exécutif No 98-96 du 18 mars 1998, modifié et complété par le Décret Exécutif No 04-304 du 13 septembre 2004, fixant les modalités d'application de l'Ordonnance No 97-06 du 21 janvier 1997, relative aux matériels de guerre, armes et munitions, a instauré, d'une manière implicite, le marquage obligatoire par le fait que toute arme, pour être autorisée à la détention (importation, exportation, commercialisation), doit être identifiée d'une manière sans équivoque (par notamment: le numéro de série, année de fabrication, modèle, etc…)…

En outre, toute arme non marquée est considérée comme arme illicite. A ce titre, elle ne peut être, ni achetée, ni vendue, ni détenue et tombe sous le coup de la saisie.
