Decreto N° 881, mediante el cual se dicta el Reglamento de la Ley para el Desarme y Control de Armas y Municiones

Artículo 106. Donación o Transmisión de Arma de Fuego

La donación o transmisión de armas de fuego entre personas naturales o jurídicas, de derecho público o privado, podrá realizarse previa autorización del órgano competente de la Fuerza Armada Nacional Bolivariana para el control de armas y municiones en los siguientes supuestos:

1. Cuando el poseedor del arma de fuego manifieste en forma escrita su voluntad de no seguir detentando la misma;
2. Cuando los legítimos herederos de una persona fallecida autorizada para el porte o tenencia de arma de fuego, manifiesten la voluntad de conservar para sí dicha arma o donarla a un tercero.

La persona que recibirá el arma de fuego objeto de la donación o transmisión deberá cumplir con los requisitos establecidos en la Ley para el Desarme y Control de Armas y Municiones y en la Providencia Administrativa o normativa interna del órgano competente de la Fuerza Armada Nacional Bolivariana para el control de armas.

Decree No. 881, promulgating Regulations for the Law on Disarmament and Control of Firearms and Ammunition

Article 106. Donation or Transfer of Firearms

The donation or transfer of firearms between natural and legal persons, under civil or private law, shall only take place subject to the authorisation of the competent body of the National Bolivarian Armed Forces for the control of arms and ammunition, under the following premises:

1. When the firearm's bearer shall express, in written form, his willingness not to keep the firearm;
2. When the legitimate heirs of a deceased person authorised for the carrying and ownership of firearms express their willingness to keep the firearm or give it to another person.

The person who shall receive the donated or transferred firearm shall fulfil the requirements established by the Law for the Disarmament and Control of Arms and Ammunition and in the Administrative Ruling or the normative of the competent body of the National Bolivarian Armed Forces for the control of arms.
