Article 20:

Modifié par Arrêté du 20 juin 2011 - art. 1

Le service des douanes, lorsqu'il estime, tant à l'importation qu'à l'exportation, que les marchandises déclarées sous une dénomination tendant à laisser croire qu'elles ne constituent pas des matériels visés par le présent arrêté consistent, en fait, en matériels de l'espèce, doit saisir le comité, prévu par l'article L. 2335-31 du code de la défense qui statuera.

En ce qui concerne les armes de la première catégorie acquises pour la pratique de tir sportif, les armes de la 4e, de la 5e ou de la 7e catégorie, les contestations visées au précédent alinéa seront examinées dans les conditions fixées au deuxième alinéa de l'article 21.2

Les dispositions des deux alinéas précédents sont applicables aux armes, munitions et leurs éléments de la 1re catégorie (§ 1 à 3) acquis à titre personnel, du I de la 4e catégorie, de la 5e et de la 7e catégorie, transférés en provenance ou à destination d'un Etat membre de l'Union européenne.

Article 20:

Modified by the Order of June 20, 2011 - Art. 1

Customs services, when they consider that, for import and for export, the goods declared under a description which tends to suggest that they are not materials referred to in this Order, consist in fact of materials in this case, must refer to the Committee which will decide, as provided for in Article
L. 2335-31 of the Defence Code.

Concerning firearms of the first category acquired for sports shooting, and firearms of the 4th, 5th or 7th category, disputes mentioned in the above paragraph are examined under conditions set by the second paragraph of Article 21.2

Provisions of the two above paragraphs are applicable to firearms, ammunition and their components of the 1st category (paragraphs 1 to 3) acquired for personal use, of I of the 4th category, of the 5th and 7th categories, transferred from or to a Member State of the European Union.
