Article 12 bis:

Créé par Arrêté du 20 juin 2011 - art. 1

La réimportation des matériels exportés temporairement est garantie par un acquit-à-caution délivré conformément au code des douanes. Lorsque les matériels sont expédiés directement à des gouvernements étrangers ou que le pays destinataire est un Etat membre de l'Union européenne ou lorsqu'il s'agit de matériels exportés sous le régime du perfectionnement passif en application du e de l'article 13,1 l'acquit-à-caution est remplacé par une soumission dispensée de caution.

L'acquit-à-caution ou la soumission ne peuvent être déchargés que sur présentation de la déclaration de douane de réimportation des matériels.

L'administration des douanes et droits indirects peut accorder une dispense d'acquit-à-caution ou de soumission pour les envois de faible importance.

Sont dispensées des formalités prévues par le présent article les expéditions des matériels bénéficiant des dérogations prévues aux articles 13 à 16,1 2 à l'exception du e de l'article 13 ou bénéficiant d'une autorisation d'exportation revêtant une forme globale.

Created by the Order of June 20, 2011 - Art. 1

The re-import of temporarily exported materials is guaranteed by a bond note issued in accordance with the Customs Code. When materials are conveyed directly to foreign governments, or when the country of destination is a Member State of the European Union, or in the case of materials exported under inward processing regime under Article 13 e),1 the bond note is replaced by a tender exempt of deposit.

The bond note or tender may only be discharged on presentation of the Customs notification of re-import of the materials.

The Customs and Indirect Rights Administration may grant a bond note or tender dispensation for consignments of low importance.

Consignments of materials subject to exemptions provided for in Articles 13 to 16,1 2 except of the e) of Article 13, or subject to a global export authorisation, are dispensed of the formalities provided for in this article.
