Titre IV: Dérogations à la prohibition d'importation

Article 72:

Par dérogation à la prohibition d'importation de l'article L. 2335-11 du code de la défense, des autorisations peuvent être accordées par le ministre chargé des douanes sur avis favorable des ministres de la défense, de l'intérieur et des affaires étrangères.

Paragraphe 1: En ce qui concerne les matériels de guerre, armes, éléments d'arme, munitions et éléments de munition classés dans les quatre premières catégories:2 3

1. Aux personnes qui répondent aux conditions prévues par le présent décret pour en faire la fabrication ou le commerce.
2. Aux personnes qui ont obtenu, dans les conditions définies par le présent décret, l'autorisation d'en faire l'acquisition ou de les détenir.

Paragraphe 2: En ce qui concerne les armes, éléments d'arme, munitions et éléments de munition classés dans la 5e catégorie:4

1. Aux fabricants et commerçants ayant satisfait, selon le cas, aux prescriptions de l'article 6,5 de l'article 76 ou de l'article 87 ci-dessus.
2. Aux autres personnes, sur présentation des pièces prévues à l'article 46-28 du présent décret.

Title IV: Exceptions to the Import Prohibition

Article 72:

Notwithstanding the import prohibition of Article L. 2335-11 of the Defence Code, authorisations may be granted by the Minister in charge of Customs, on favourable opinion of the Ministers of Defence, Interior and Foreign Affairs.

Paragraph 1: Concerning weapons of war, firearms, components of firearms, ammunition and components of ammunition listed in the first four categories:2 3

1. To individuals complying with the conditions provided for in this Decree with a view to manufacture or trade.
2. To individuals who have received, under conditions defined by this Decree, an authorisation to purchase or to possess them.

Paragraph 2: Concerning firearms, components of firearms, ammunition and components of ammunition, listed in the fifth category:4

1. To manufacturers and dealers who have complied, as applicable, with the requirements of Article 6,5 Article 7,6 or Article 87 above.
2. To other individuals, on presentation of the documents provided for in Article 46-28 of this Decree.
