Autorisation d'exportation

Le dispositif de contrôle mis en place par le code de la défense et ses textes d'application se déroule en deux phases:

Les opérations portant sur des armes légères et de petit calibre sont examinées par la CIEEMG, créée par le décret n°55-965 du 16 juillet 1955. Au vu de l'avis rendu par cette commission, le SGDSN prend la décision finale, par délégation du Premier Ministre. II est alors notifié un agrément préalable ou un refus.

Dans un second temps, le demandeur, disposant de cet agrément préalable, peut solliciter une AEMG. Ce document est délivré par le ministère en charge des douanes et permet l'exportation physique du matériel, dans les conditions fixées par I' agrément préalable.

S'agissant des transferts intracommunautaires d'armes de poing à usage civil, ou d'armes longues détenues régulièrement par des particuliers, la France applique les dispositions de la directive 91/477/CEE, relative au contrôle de l'acquisition et de la détention d'armes. A ce titre, les transferts de ces armes, dans l'espace communautaire vers des particuliers, ne relèvent pas de la procédure CIEEMG.

The control mechanism established by the Defence Code and its implementing texts takes place in two phases:

The operations on small arms and light weapons are examined by the CIEEMG, created by Decree 55-965 of 16 July 1955. Given the opinion of this Commission, the SGDSN takes the final decision, by delegation of the Prime Minister. A preliminary agreement or refusal is then notified.

In the second phase, the applicant who has this prior agreement can apply for an AEMG. This document is issued by the ministry in charge of Customs and allows the physical export of goods under the conditions set by the prior agreement.

Concerning intra-Community transfers of handguns for civilian use or long guns usually owned by individuals, France implements provisions of the 91/477/CEE directive concerning the control of the acquisition and possession of arms. As such, transfers of these arms in the intra-Community space to individuals do not come within the CIEEMG procedure.
