Controles Aplicables a la Exportación, Importación y Tránsito

Toda firma exportadora, una vez cumplimentados los requisites que lo habilitan como legitimo usuario comerclal debe obtener una segunda licencia que lo autoriza a realizar cada operación en particular.

Los Decretos 760/92 y 437/00 regulan las exportaciones de armas de uso civil, uso civil condicional, municiones, repuestos principales y demas materiales controlados.

Para obtener una Licencia o Autorización de Exportación es necesario que la empresa exportadora presente el Certificado Internacional de impartación o Certificado de Usuario Final emitido poria autoridad competente en el pais de destine.

Dicho certificado debe consignar los datos completes del exportador, del importador en el pais de destina, la mercadería a exportar (tipo de arma y sistema de disparo, marca, modelo, calibre y numero de serie y/o tipo de munición, tipo de punta, marca, calibre y lote de produccion). El documento debe ser intervenido por el Consultado Argentino en el pais de destino, quien certificará que las firmas que obran en el sean autenticas y pertenezcan a la autoridad competante facultada para expedir el certificado. El procedimiento aplicable se encuentra establecido en la disposición RENAR 099/05 del 23 de mayo de 2005.

La Licencia de Exportación emitida por el RENAR lleva un sello donde se establece la prohibición de re-exportar el bien controlado sin la previa autorización de ese organismo.

Una vez obtenida la Licencia de Exportación, se solicita la Verificación del material registrado objeto de dicha exportación ante el RENAR. De esta manera. antes que la mercaderia salga del territorio argentino, es necesaria la intervención de una Comisión Verificadora integrada por funcionarios del RENAR, de la Aduana Argentina, de las fuerzas de seguridad intervinientes según el punto de salida del material y que actua como Autoridad Local de Fiscalización (Policia de Seguridad Aeroportuaria, Prefectura Naval o Gendarmeria Nacional) y el representante del exportador.

Una vez realizada la verificación se labra un Acta donde se consignan los detalles del material exportado (tipo de arma, sistema de disparo, marca, calibre y numero de serie para el caso de las armas y maroa, calibre, cantidad y lote para el caso de las municiones). Los datos contenidos en el Acta de Verificación, que deben ser identicos a los contenidos en el Certificado de usuario final, son ingresados finalmente al Banco Nacional de Datos informatizado del RENAR.

El articulo 30 del Decreto 395/75 establece el procedimiento vigente para la
autorización de importaciones, el cual en la practica, se realize de modo analogo al procedimiento aplicable a las exportaciones. En este caso, el importador debe estar registrado como legitimo usuario comercial, y contar con la autorización para la operación en cuestión. Dicha Autorización de importación requiere que se presente la siguiente documentación: factura original, manifiesto de carga, conocimiento de embarque, la lista de empaque, Despacho de Aduana Oficializado. En este caso, tambienn interviene la Comisión Verificadora quien labra el Acta que será ingresada al Banco de Datos informatizado del RENAR.

Por último, con relación al tránsito de armas, este no puede hacerse sin la previa autorización el RENAR, ante quien se debe presentar el certificado de usuario final expedido por la autoridad competente del pais de destino (certificado por el Consulado Argentino en ese) y la Autorización de Exportación, expedido por autoridad competente del pais de origen (intervenido por el Consulado Argentino en aquel). El procedimlento aplicable se encuentra establecido en la disposición RENAR 099/05 del 23 de mayo de 2005.

El Decreto 603/92 (modificado por el Decreto 437/2000) regula las exportaciones de armas de uso bélico - uso exclusivo de las instituciones armadas - y material sensitivo y de uso dual. En este caso el control es ejercido por la Comisión Nacional de Control de Exportaciones Sensitivas y Material Bélico compuesta por los Ministerios de Relaciones Exteriores, Defensa y Economía. Esta Comisión tambien controla las transferencias de materiales, equipos, tecnologias, asistencia tecnica y/o servicios de naturaleza nuclear, quimica, bacteriológica o misilistica.

Al igual que en el caso de las armas de uso civil y uso civil condicional, es obligatoro obtener una autorización previa para las exportaciones alcanzadas por el Decreto 603/92. Las solicitudes son analizadas caso par caso y la decisión sobre ellas es tomada teniendo en cuenta el firme compromiso de la Republica con la no proliferación, condiciones internacionales (marco individual y regional. etc.) y las condiciones especificas que se establecen para cada supuesto concreto.

Segun el Decreto 657/95 del 8 de mayo de 1995, la Comisión Nacional de Control de Exportaciones Sensitivas y Material Belico debera exigir antes de autorizar la exportación un "certificado de uso final" - tambiem intervenido por el Consulado Argentina en el pais de destino - en el que conste quien es el destinatario final del material belico y que el mismo no será reexportado sin la autorización de las autoridades competentes de la Republica Argentina. El certificado de usuario final deberá contener una certificación del Ministerio de Defensa o autoridad competente del pais que lo expida, que comprenda los datos del comprador y del usuario final del material belico vendido, debera detallar el material que se compra y acompanar toda la documentación que acredite fehacientemente la operación, reservandose el derecho de autorizar o no a dicho usuario final la reexportación del material.

Al mismo tiempo, la Argentina es Estado participants del Wassenaar Arrangement en cual se han adoptado criterios y directrices sobre control de exportaciones de material belico y tecnologia y bienes sensibles y de usa dual. En materia de armas pequeñas y ligeras se adoptaron los siguientes documentos "Directrices sobre Mejorar Practicas para el Control de Armas Pequeñas y Ligeras" (2002) y a los "Elementos para el Control de las Exportaciones de los Sistemas Portatiles de Defensa Antiaérea" (MANPADS) (2003).

Controls Applicable to Export, Re-export, Import and Transit

Once it has been licensed as a lawful commercial user, the exporting firm must obtain a second licence authorizing it to perform specific operations.

Decrees No. 760/92 and 437/2000 regulate exports of arms for civilian use or conditional civilian use, ammunition, spare parts and other controlled materials.

In order to obtain an export licence or authorisation, the exporting firm must present either an international import certificate or an end-user certificate issued by the competent authority in the country of destination.

This certificate must provide full details of the exporter, the importer in the country of destination and the goods to be exported (type of weapon, firing mechanism, make, model, calibre and serial number and/or type of ammunition, type of tip [type of projectile?], make, calibre and batch number). The Argentine consulate in the country of destination must authenticate the certificate and certify that the signatures appearing thereon are authentic and pertain to the competent authority empowered to issue the certificate. The procedure applicable is set out in provision RENAR 099/05 of 23 May 2005.

The export licence issued by RENAR bears a stamp indicating that the controlled item may not be re-exported without the prior authorization of RENAR.

Once the exporting firm has been issued with an export licence, it must request that the material registered with RENAR for export be verified. Accordingly, before the merchandise leaves Argentina, it must be controlled by a verification commission composed of officials from RENAR, Argentine Customs and whichever security force is in charge at the material's point of exit and therefore plays the role of local monitoring authority (i.e. Airport Security Police, Coast Guard or National Gendarmerie), and the exporter's representative.

Once the material has been verified, a certificate is issued giving details of the exported material (type of weapon, firing mechanism, make, calibre and serial number in the case of weapons; and make, calibre, quantity and batch number in the case of ammunition). The information contained in the verification certificate, which must be identical to that contained in the end-user certificate, is then entered into the national database maintained by RENAR.

Decree No. 603/92 (as amended by Decree No. 437/2000) regulates the export of weapons for military use - which are used exclusively by the armed forces - and sensitive and dual-use materials. Responsibility for controlling such items lies with the National Commission for the Control of Sensitive Exports and Military Material, which is composed of the Ministries of Foreign Affairs, Defence and the Economy. This Commission also controls transfers of nuclear, chemical, bacteriological or missile-related materials, equipment, technology, technical assistance and/or services.

As in the case of weapons for civilian use and conditional civilian use, prior authorization must be obtained for exports covered by Decree No. 603/92. Requests are considered on a case-by-case basis, with the final decision taking account of Argentina's firm commitment to non-proliferation, international conditions (individual and regional framework, etc.) and the specific conditions established for each particular case.

Pursuant to Decree No. 657/95 of 8 May 1995, the National Commission for the Control of Sensitive Exports and Military Material, before authorising the export, must require an end-user certificate - duly authenticated by the Argentine consulate in the country of destination - identifying the end-user of the military material and attesting that it will not be re-exported without the authorisation of the competent authorities of Argentina. The end-user certificate must contain a certification from the Ministry of Defence or other competent authority of the country issuing it, including information on the buyer and the end-user of the military material being sold. The certificate must also specify the material being purchased and be accompanied by all the documentation required to authenticate the transaction convincingly. The Commission reserves the right to authorise, or refuse to authorise, the end-user to re-export the material in question.

Argentina is also a participating State in the Wassenaar Arrangement, in the framework of which criteria and guidelines have been adopted for the control of exports of military material and sensitive and dual-use goods and technologies. With regard to small arms and light weapons, the following documents have been adopted: Best Practice Guidelines for Exports of Small Arms and Light Weapons (2002) and Elements for Export Controls of Man-Portable Air Defence Systems (2003).
