Controles Aplicables a la Producción y Comercialización

Quienes se dediquen a la fabricación de armas en el territorio argentino, deben estar previamente inscriptos en el Registro Nacional de Armas (RENAR), en el rubro fabricante de armas, y/o municiones. Dicha inscripción es condición previa para la habilitación de la planta o fábrica.

Con relación a la producción de armas, los fabricantes deben remitir en forma mensual los informes correspondientes a su producción. El procedimiento administrativo para la Habilitación de Fabricas y Fabricantes de Materiales, Componentes y Elementos Auxiliares para Materiales Esencialmente Militar está contenida en la Ley N° 12.709, reyes complementarias, Decretos, Resoluciones y en la Disposición RENAR N° 197/04 adoptada 30 de noviembre de 2004.

Toda operación de compra/venta de armas debe ser asentada por los usuarios
comerciales en un Libra Registro Oficial de Operaciones y producir un informe
trimestral que es elevado al RENAR. El informe debe contener los datos completes del comprador (que, a su vez, debe estar inscripto como legitimo usuario en dicho organismo) y de las armas y/o municiones enajenadas (tipo de arma, sistema de disparo, marca, modele, calibre y numero de serie - tipo de munición, tipo de punta, marca, calibre y late de producción.

A su vez, los legítimos usuarios comerciales (mayorista o minorista) deben también registrar la entrada, así como las salidas, de todos los materiales controlados en el referido Libro Registro Oficial de Operaciones, verificando siempre que el destinatario final sea también un legitime usuario en cualquiera de sus distintas categorías.

Para poder retirar un arma de una armería el legitime usuario debe presentar la
credencial de tenencia a su nombre, debiendo tramitarla con carácter previo ante el RENAR. Para la adquisición de municiones deberán presentar la Tarjeta de Control de Consumo de Municiones que se otorga par cada calibre para todo tipo de arma. Esta Tarjeta también limita la cantidad máxima que por calibre puede ser mantenida en existencia par el legítimo usuario.

Controls Applicable to Production and Sale

Anyone involved in manufacturing weapons in Argentina must be registered as a manufacturer of arms and/or ammunition with RENAR. Only plants or factories that are registered as such will be granted a licence.

Every month, manufacturers are required to submit a weapon production report. The administrative procedure for licensing factories and manufacturers of materials, parts and auxiliary components for essentially military materials is contained in provision RENAR N1 197/04, adopted on 30 November 2004.

Commercial users must register every purchase or sale of weapons in an official register of operations and submit a quarterly report to RENAR. The report must contain full details of the buyer (who in turn must be registered as a lawful user with RENAR) and of the weapons and/or ammunition being transferred (type of weapon, firing mechanism, make, model, calibre and serial number - type of ammunition, type of tip [type of projectile?], make, calibre and batch number).

In turn, lawful commercial users (whether wholesalers or retailers) must also record the entry and exit of all controlled materials in the aforementioned official register of operations, verifying at all times that the end-user falls into one of the various categories of lawful user described above.

Lawful users wishing to remove a weapon from a gunsmith's shop must present their personal user authorization number, which must have been requested previously from RENAR. Those wishing to purchase ammunition must present the ammunition consumption control card issued for each calibre of ammunition and each type of weapon. This card also establishes the maximum amount of ammunition, per calibre, that lawful users may have in their possession.
