L'article L2339-11 du code de la défense prévoit une amende de 3,750 euros et un emprisonnement de deux ans pour l'usage par une personne non qualifiée d'un poinçon d'épreuve. Les contrefaçons d'un poinçon d'épreuve ou du poinçon d'exportation et l'usage frauduleux des poinçons contrefaisants sont punis d'une amende de 3,750 euros et d'un emprisonnement de cinq ans.

Le décret 60-12 du 12 janvier 1960 stipule que la vente et/ou l'introduction en France d'une arme n'ayant pas subi les épreuves d'un Etat partie à la CIP sont répréhensibles.

Article L2335-3 du code de la défense indique également que tous les canons d'armes de guerre destinés au commerce extérieur sont soumis à des épreuves constatées par l'application d'un poinçon. Ces canons reçoivent, en outre, une marque dite d'exportation.

Afin de se conformer aux nouvelles dispositions de la directive 91/477/CE modifiée, un projet de Décret actuellement en cours d'élaboration doit préciser les caractéristiques du marquage des armes à leur fabrication (indication du fabricant, pays ou lieu de fabrication, année de fabrication, du modèle, du calibre et du numéro de série). Il précisera également l'obligation de marquage pour les armes à feu appartenant à l'Etat en cas de cession.

Pour les armes destinées aux armées, le marquage est spécifié dans le contrat et contrôlé par le service compétent de la Délégation Générale pour l'Armement (DGA). Les opérations d'immatriculation sont par ailleurs précisées par l'Instruction 20812 de la direction centrale du matériel de l'armée de Terre du 21 mai 2001.

Marking

Article L2339-11 of the Defence Code provides a fine of 3,750 Euros and 2 years imprisonment for the use of a firearm without a proof mark. Counterfeit proof marks or export marks and the fraudulent use of counterfeit proof marks are punished with a fine of 3,750 Euros and 5 years of prison.

Decree 60-12 of 12 January 1960 prohibits the sale and/or introduction into France of a firearm not submitted to proof marking by a State party to the CIP.

Article L2335-3 of the Defence Code also indicates that all weapons of war destined for foreign trade must be proof-marked. These weapons receive an export mark.

In order to conform to the new provisions of amended directive 91/477/CE, a Decree project currently being elaborated will specify the characteristics of firearm marking during manufacture (manufacturer's symbol, country or place of manufacture, year of manufacture, model, calibre and serial number). It will also specify and obligation to mark state-held firearms that are being transferred.

For arms destined for the defence forces, marking is specified in the contract and is controlled by the competent service of the General Delegation for Armament (DGA). Operations of matriculation are also provided for by the Instruction 20812 of the Central Directorate of the Army of 21 May 2001.
