La Gestión y Seguridad de los Stocks

La gestión y seguridad de los stocks de las armas en posesión de las Fuerzas de
Seguridad está regulada por la Ley nacional de Armas No 20.429 y su decreta
reglamentario. Asimismo, cada Fuerza cuenta con normativas internas relativas a la seguridad de la guarda de dichas armas.

No obstante ella, entre las medidas a desarrollar en el marco del Programa Nacional de Control de Armas (desarrollado en el punta 9 del presente informe), se propuso la ejecución de "Programas para mejorar el control y manejo de los arsenales de las Fuerzas de Seguridad", a efectos de crear registros, controles, medidas de seguridad física, auditorias, etc. Para ella, se planea llevar a adelante el diseño e implementación de sistemas de manejo de arsenales y programas de destrucción de excedentes.

El 20 de diciembre de 2006 se sancionó la Ley 26.216 por la cual, entre otras
cuestiones reitera obligaciones del RENAR comprendidas en otras disposiciones relativas a la creación de un inventario de armas, municiones, repuestos principales y materiales controlados, sean de carácter público o privado en todos el territorio nacional. Asimismo, el artículo 16 de la mencionada ley establece que las Fuerzas Armadas, de Seguridad y Policía Federal deberán efectuar un nuevo inventario de las armas de fuego comprendidas en la Ley 20.249 y deberán informar trimestralmente al Congreso de la Nación respecto aquellas que han sido perdidas o desviadas de sus arsenales, brindando un detalle acerca de las características del arma, de la unidad a cargo de su custodia, fecha, lugar, circunstancias del caso y sanciones aplicadas.

Management and Security of Weapons Stocks

The management and security of weapon stocks held by the security forces is governed by the National Weapons and Explosives Act No. 20.429 and the decree regulating its implementation. In addition, each force has its own internal regulations governing the safekeeping of such weapons.

In addition, the measures to be carried out under the National Weapons Control Programme (see point 9 of this report) include the proposed implementation of "Programmes to improve the control and management of the arsenals of security forces" in order to establish registers, controls, physical security measures, audits, etc. To achieve this, there are plans to design and implement arsenal management systems and programmes for the destruction of surplus weapons.

On 20 December 2006, Act No. 26,216 was adopted. The Act sets out, inter alia, obligations on the part of RENAR which are contained in other provisions on the establishment of an inventory of weapons, ammunition, main spare parts and controlled materials held by the Government or private entities, throughout the national territory. Similarly, article 16 of the Act provides that the armed forces, security forces and federal police must draw up a new inventory of the firearms covered under Act No. 20.429 and inform Congress quarterly of those that have been lost or diverted from their arsenals, providing information on the arms' characteristics, the entity responsible for their safekeeping, the date, location and circumstances of the loss or diversion and the applicable penalties.
