Registro, marcaje y rastreo de armas pequeñas

IV. Normas, procedimientos y actividades realizadas para asegurar la aplicación efectiva del instrumento de marcaje.

En mayo de 2007, mediante Resolucion Ministerial N° 134-2007-PCM, se creo la
Comision Nacional contra la Fabricación y el Trafico Ilicitos de Armas de Fuego,
Municiones, Explosivos y otros Materiales Relacionados - CONATIAF para asumir,
entre otros, las funciones atribuidas al "Contacto Nacional" previsto en el Instrumento Internacional de marcaje (ITI).

Las actividades de rastreo de las armas pequeñas y ligeras y sus municiones se
encuentran a cargo de la Direccion General de Inteligencia del Ministerio del Interior (DIGIMIN) y la DICSCAMEC, con la cooperación de la OCN-INTERPOL-LIMA, y el Comando Conjunto de las Fuerzas Armadas (CCFFAA), quienes atienden las
solicitudes de información para el rastreo de las armas de fuego en otros Estados Parte o desde otros Estados parte.

Llevando un debido y actualizado registro de armas, ya sean de uso civil como de
guerra, permite el rastreo y la identificación de las armas de fuego que han sido fabricadas, sustraidas o traficadas ilicitamente.

Rastreo internacional de armas de fuego

Esta actividad se realiza a través de la OCN-INTERPOL-LIMA, aplicando los siguientes procedimientos:

A. Solicitudes y/o pedidos de rastreo del Peru hacia otros paises:
Los pedidos de información de la OCN-INTERPOL-LIMA se realizan mediante Mensajes de Difusion Internacionales, solicitando a sus similares a traves de la
Secretaria General en Lyon Francia, si las armas de fuego que se consigna se encuentran registradas en su base de datos, como incriminadas, robadas o perdidas. Estas son realizadas a solicitud de la DICSCAMEC, en aplicación de la Ley de Amnistia N° 26397 y su reglamento N° 002-2005-IN, tendiente a establecer su procedencia y regularizar su situacion en el Peru.

En el 2008 las solicitudes de información a nivel internacional sobre registros de las armas de fuego consultadas ascendieron a 10 y en el 2009 sólo se registra 1 pedido.

b. Solicitudes de otros paises hacia el Peru:
Los pedidos de información sobre armas de fuego de las otras oficinas de INTERPOL a nivel internacional, son recibidas por el sistema I/24 7 (información las 24 horas del dia los 7 dias de la semana), estos son registrados y procesados debidamente mediante coordinaciones y pedidos a la DICSCAMEC.

En el 2008 por parte de las similares OCN INTERPOL, se recibieron 21 consultas,
mientras que en el año 2009 se recibieron 15-consultas.

IV. Rules, procedures and activities undertaken to ensure the effective implementation of the tracing instrument.

Through the Ministerial Resolution No. 134-2007-PCM, in May 2007, the National Commission Against the Illicit Manufacturing of and Trafficking in Firearms, Ammunition, Explosives and Other Related Materials - CONATIAF, was created to assume, amongst others, the functions assigned to "National Contacts" under the International Tracing Instrument (ITI).

The Interior Ministry's General Intelligence Directorate (DIGIMIN) and DICSCAMEC are in charge of tracking activities for small arms and light weapons and ammunition, in cooperation with NCB-INTERPOL-LIMA, and the Joint Command of the Armed Forces (CCFFAA), who cater to the requests for information on the tracing of firearms in other State Parties or from other State Parties.

Having an up-to-date register for weapons, whether for civilian use or for war, allows the tracking and identification of firearms that have been manufactured, stolen or illicitly trafficked.

The International tracing of firearms

This activity which is conducted through OCN-INTERPOL-LIMA, applies the following procedures:

a. Applications and/or tracing requests from Peru to other countries:
Requests for information of OCN-INTERPOL-LIMA are made through international broadcast messages, asking their peers through the General Secretariat in Lyon France, if firearms that are recorded are found registered in their database as incriminating, lost or stolen. These are conducted at the request of DICSCAMEC, under Amnesty Law No. 26397 and its Regulation No. 002-2005-IN, tending to establish its origin and to regularize their situation in Peru.

In 2008, requests for information at the international level regarding records of firearms viewed reached 10, and in 2009 there was only 1 request recorded.

b. Requests from other countries to Peru:
The information requests on firearms from other worldwide INTERPOL offices, are received by the system I/24 7 (information received 24 hours a day, 7 days a week), are recorded and processed appropriately through requests from DICSCAMEC.

In 2008, on the part of OCN INTERPOL, there were 21 consultations, while in 2009 there were 15 consultations received.
