II convient de préciser cependant que la classification en trois catégories des délits qui découle de la nouvelle rédaction du chapitre III du Nouveau Code pénal permet de différencier et d'individualiser les sanctions applicables. En effet, en vertu de l'article 263 du Nouveau Code pénal, Je port et la possession illégaux d'armes sont punis avec une peine d'emprisonnement d'un an, pouvant appliquer une peine de trois mois à trois ans d'emprisonnement en cas de circonstance aggravante, comme par exemple s'il s'agit d'une arme courte à feu, s'il manquent les marques de fabrication ou si elles ont été altérées, ou si elles ont été introduites de façon illégale sur le territoire andorran.

However, it should be noted that the classification in three categories of offences originating from the new version of the Chapter III of the Penal Code allows the differentiation and individualisation of the applicable sanctions. Trafficking and stockpiling of firearms in a depot, regulated and prohibited, is presently described in article 264 of the Penal Code and can imply a sentence of imprisonment of 4 years.

Finally, concerning weapons of war, their manufacture, development, sale, transfer of stockpiling of firearms in a depot are punished with a sentence of imprisonment from 4 to 10 years.
