Artículo 145. Armas en Depósito Sujetas a Procesos Judiciales

Se decreta el comiso a favor del Estado de Guatemala, mediante las gestiones que para el efecto autoricen los jueces competentes, de las armas clasificadas en esta Ley, que se encuentran en depósito en el departamento de control de armas y municiones y la que quede en depósito en la DIGECAM cuyo proceso haya fenecido, las que podrán pasar, después de su marcaje y registro, a favor de las instituciones de seguridad del Estado; aquellas que se determinen como inservibles deberán ser destruidas inmediatamente.

Article 145. Seized Firearms Being Used in Criminal Investigations

It is decreed that arms linked to criminal investigations which are temporarily stored in the Office for Arms and Ammunition Control will be transferred to State forces once the investigation finishes. This must be authorised by a competent judge. The arms must be marked and registered. Those arms unfit for use must be destroyed immediately.
