Articulo 71. Casos de Excepción

La DIGECAM podrá otorgar la tenencia y/o la licencia de portación de armas de fuego en las clasificadas de uso y manejo individual, y las de uso de las fuerzas de seguridad y orden público del Estado, a las personas individuales o jurídicas, según sea el caso, cuyo objeto es la prestación de servicios privados de seguridad, única y exclusivamente para custodia de distribución de valores monetarios en el sistema financiero nacional, situación que deberá constar en el contrato de servicio vigente, y debiéndose cumplir con los requisitos que se establezcan en el Reglamento de la presente Ley.

En el caso de los ciudadanos cuya seguridad haga necesaria la tenencia y/o la licencia de portación de las armas a las que se refiere el presente artículo, deberán obtener el dictamen favorable del despacho superior del Ministerio de la Defensa Nacional, el que determinará el tipo de arma y la cantidad a autorizar, las medidas de seguridad de las mismas y escoltas de seguridad que llenen los requisitos de portación que establece la presente ley.

La licencia de portación de los casos de excepción establecidas en este artículo tendrán vigencia por el plazo de un (1) año. Para solicitar la renovación de la licencia, el solicitante deberá demostrar que la situación que motivo la autorización original persistente.

Article 71. Exceptions

The Office for Arms and Ammunition Control may grant a possession and/or carrying licence for Army exclusive and individual handling firearms, solely and exclusively to individuals or legal entities providing private security during the transportation of monetary values within the domestic financial system. This service must be included in the existing service contract and all the requirements established by the Norms of this Law must be met.

Citizens whose security requirements makes it necessary to have a possession and/or carrying licence for the arms described in this Article, must get the approval of the top office of the Ministry of National Defence, which will determine the type and quantity of authorised arms, their security measures and if the bodyguards fulfill the requirements concerning firearm carrying described in this Law.

The carrying licence for the exceptions mentioned in this Article will be valid for one year. To apply for licence renewal, the applicant must demonstrate that the situation that prompted the original authorisation still persists.
