Artículo 72. Licencia

Los ciudadanos, para portar armas de fuego de las permitidas en la presente Ley, deben obtener previamente la licencia de portación. La licencia puede cubrir y amparar hasta tres (3) armas diversas, que deberán ser previamente registradas en la DIGECAM.

La DIGECAM procederá simultáneamente a registrar la tenencia de un arma cuando un ciudadano solicite la licencia de portación de un arma que no esté previamente registrada.

La DIGECAM extenderá la licencia de portación de armas de fuego, la cual tendrá vigencia de uno (1) a tres (3) años, pudiendo ser renovada; previo cumplimiento de los requisitos siguientes:

a) Solicitud en formulario que proporcionará la DIGECAM la cual deberá contener:
1. Nombres y apellidos completos del solicitante, edad, estado civil, nacionalidad, profesión o actividad a que se dedica, residencia, número del documento de identificación personal y lugar para recibir notificaciones.
2. Marca modelo calibre, largo del cañón o cañones, número de serie del arma e identificación de las conversiones de calibre que tuviere.
3. Declaración jurada que no padece ni ha padecido de enfermedades mentales ni es desertor del Ejército de Guatemala y/o abandono de empleo en la Policía Nacional Civil.

b) Acompañar los siguientes documentos:
1. Fotocopia legalizada del documento de identificación personal.
2. Certificación de carencia de antecedentes penales y policíacos extendida por las autoridades correspondientes.
3. Certificación de haber superado las evaluaciones establecidas en el artículo 751 de la presente Ley.

Los datos y documentos que se remitan a la DIGECAM serán hechos bajo declaración jurada prestada ante notario público de conformidad con la ley, que toda la información es verídica.

c) Pago de la tarifa especial respectiva la cual se fijará en el Reglamento de la presente Ley

Article 72. Gun Carrying Licence

In order to carry the firearms authorised by this Law, citizens must have a carrying licence. A licence could cover up to three firearms, which must have been previously registered at the Office for Arms and Ammunition Control.

The Office for Arms and Ammunition Control will issue the carrying licence, which could be valid for one up to three years and could be renewed, after the following requisites have been met:

a) Provide the following information in the form provided by the Office for Arms and Ammunition Control:
1. Names and family names of the applicant, age, marital status, nationality, occupation, place of residence, ID number and address where notifications could be sent.
2. The firearm's make, model, calibre, length of barrel or barrels, serial number and calibre adaptations.
3. Affidavit that the applicant does not suffer or has suffered any mental illness or that he/she has not deserted from the Army or the Police.

b) Attach the following documents:
1. Certified copy of the personal ID
2. Certification of no criminal or police records
3. Certification of having approved the tests described in the Article 751 of this Law

The applicant must swear before a Notary that all the information and documents submitted to the Office for Arms and Ammunition Control is true.

c) To pay the fees which will be set by the Norms of this Law.
