12. Prohibition on dealing in firearms without being registered
(1) Subject to this section, no person —
shall sell or transfer or expose for sale or transfer or have in his or her possession for sale, transfer, repair, test or prove any firearm or ammunition unless he or she is registered under this Act as a firearms dealer; or
shall repair, test or prove any firearm or ammunition unless he or she is registered under this Act as a gunsmith.
Nothing in this section shall be deemed to prohibit the sale, repair, test or proof by any person of any firearm or ammunition in respect of which he or she is the holder of a firearm certificate issued under this Act.
Any person who contravenes any of the provisions of subsection (1) commits an offence and is liable to imprisonment for a term not exceeding five years or to a fine not exceeding twenty thousand shillings or to both.
