Artigo 50.º Licença para comércio de armas e munições

1. O comércio de armas e munições a que se referem a presente lei, bem como de quaisquer réplicas capazes de induzir em erro sobre a sua autenticidade, só é permitido em estabelecimentos especifi camente licenciados para o efeito, observando-se o regime legal sobre o licenciamento administrativo para o comércio.

2. A licença a que se refere o número anterior é titulada por documento emitido pelo Director Nacional da Polícia Nacional.

3. O licenciamento a efectuar pela autoridade competente terá em conta os riscos para a segurança pública, a personalidade e a idoneidade dos responsáveis pela gestão do estabelecimento e dos seus proprietários.

4. A emissão da licença pressupõe a prestação, a favor do Estado, de caução ou garantia bancária, a ser fi xada por despacho do Director Nacional da Polícia Nacional, em valor não inferior a 5.000.000$00 (cinco milhões de escudos).

5. A licença a que se refere o presente artigo é concedida por um período de cinco anos, renovável, fi cando a sua renovação condicionada à verifi cação das condições exigidas para a sua concessão.

Article 50: License to trade in arms and ammunition

1. The trade in arms and ammunition referred to in this law, as well as any replicas capable of misleading others about its authenticity, are only allowed in establishments specifically licensed for that purpose, while observing the legal regime on licensing administration for commerce.

2. The license referred to above is certified by a document issued by the National Director of National Police.

3. The licensing process to be carried out by the competent authority shall take into account the risks to public security as well as the personality and suitability of those responsible for the management of the establishment, including its owners.

4. The issuance of the license presupposes the provision, in favour of of the State, of a guarantee or bank guarantee, to be fixed by order of the National Director of the National Police, of an amount not less than CVE 5,000,000$00 (five million escudos).

5. The license referred to in this article is granted for a period of five years, and is renewable for the same period.
