Maddə 23. Xidməti və mülki silah satışı ilə məşğul olmağa hüququ olan müəssisələrin vəzifələri

I. Xidməti və mülki silah satışı ilə məşğul olmaq hüququ olan müəssisələr aşağıdakı vəzifələri yerinə yetirməlidirlər:

1) satışda olan silahın sertifikatına malik olmalı;

2) əldə edilmiş və satılmış xidməti və mülki silahın uçotunu, eləcə də on il müddətində uçot sənədlərinin saxlanılmasını təmin etməli;

3) satışda olan xidməti və mülki silahdan atılmış gilz və güllə nümunələrini Azərbaycan Respublikası müvafiq icra hakimiyyəti orqanının nəzdində olan gülləgilztekasına təqdim etməli;

4) satışda olan silahın mühafizəsini və təhlükəsiz saxlanılmasını təmin etməli;

5) xüsusi icazə tələb olunmayan silah istisna olmaqla, alıcıdan xidməti və ya mülki silahın əldə edilməsinə icazəni təqdim etməyi tələb etməli;

6) satılmış xidməti və ya mülki silah, habelə onların alıcısı barədə üç gün ərzində Azərbaycan Respublikasının müvafiq icra hakimiyyəti orqanına onun tərəfindən müəyyən edilmiş forma üzrə məlumat təqdim etməli və özünümüdafiə silahının (aerozol qurğuları istisna olmaqla) əldə edilməsi barədə alıcının xüsusi icazəsində qeyd aparmalıdırlar.

II. Müvafiq növ xidməti və ya mülki silahın əldə edilməsinə xüsusi icazəni təqdim etməmiş fiziki və hüquqi şəxslərə belə silahın, eləcə də nömrəsiz və damğasız silahın və ya standarta uyğunluğu barədə işarəsi olmayan patronların satışı qadağandır. [27]

Article 23. Duties of enterprises entitled to engage in the sale of service and civilian weapons

I. Enterprises authorized to sell service and civilian weapons must perform the following duties:

1) have a certificate for the weapon on sale;

2) ensure the registration of service and civilian weapons acquired and sold, as well as the maintenance of accounting documents for a period of ten years;

3) submit samples of cartridges and ammunition fired from service and civilian weapons on sale to the ammunition depot under the relevant executive authority of the Republic of Azerbaijan;

4) ensure the protection and safe storage of weapons on sale;

5) require the buyer to provide a permit for the acquisition of service or civilian weapons, except for weapons that do not require a special permit;

6) within three days submit information on the sold service or civilian weapon, as well as their buyer to the relevant executive authority of the Azerbaijan Republic in the form prescribed by him and make a note on the acquisition of a self-defense weapon (except aerosol devices) in the buyer's special permit.

II. The sale of such weapons, as well as unnumbered and unmarked weapons or cartridges without a mark of conformity to the standard, to individuals and legal entities that have not provided a special permit for the acquisition of the relevant type of service or civilian weapon is prohibited. [27]
