42 c § (28.2.2020/89) Aseen ja sen osan yksilöintitietojen ilmoittaminen poliisille

Aseluvanhaltijan on ilmoitettava aseen tai sen osan hankkimisesta, lainaamisesta, valmistamisesta tai muuntamisesta poliisille 30 päivän kuluessa. Ilmoitus on tehtävä kirjallisesti tai 119 a §:ssä tarkoitettua sähköistä asiointia käyttäen.

Ilmoituksessa on esitettävä:

1) ampuma-aseen, tehokkaan ilma-aseen ja aseen osan yksilöintitiedot;

2) luovuttajan ja luovutuksensaajan nimi, osoite ja syntymäaika;

3) korjaamista tai muuntamista koskevan toimeksiannon antajan nimi;

4) ampuma-aseen, tehokkaan ilma-aseen ja aseen osan lainaksiantajan ja lainaksisaajan nimi, osoite ja syntymäaika;

5) säilyttäjän ja säilytyspaikan yksilöimiseksi tarvittavat tiedot, jos ampuma-ase, tehokas ilma-ase tai ampuma-aseen kokoamisen mahdollistavat aseen osat säilytetään muutoin kuin tilapäisesti 106 §:n 1 momentin 2 kohdassa tarkoitetulla tavalla muun kuin ampuma-aseen hallussapitoon oikeutetun luvanhaltijan luona;

6) tieto ampuma-aseen muuntamisesta, jos ampuma-aseen tyyppi, toimintatapa tai kaliiperi muuttuu taikka ase deaktivoidaan tai hävitetään;

7) hankkimisen, lainaamisen, valmistamisen tai muuntamisen ajankohta.

Edellä 2 momentissa tarkoitetut tiedot on ilmoitettava myös luovuttajan tai lainaksiantajan luovutuksen, lainaamisen tai lainasta palauttamisen yhteydessä, jos luovuttaja tai lainaksiantaja on 20 §:ssä tarkoitettu asealan elinkeinoluvan haltija.

3 momentti tulee voimaan 1.3.2024.

Ampuma-aseen, tehokkaan ilma-aseen tai aseen osan lainaksiantaja saa jättää 1 momentissa tarkoitetun ilmoituksen tekemättä, jos ase tai sen osa on lainaksisaajan hallussa enintään 30 päivän ajan lainaksiantamisesta.

Valtioneuvoston asetuksella annetaan tarkemmat säännökset ampuma-aseen, tehokkaan ilma-aseen ja aseen osan yksilöintitietojen ilmoittamista koskevista menettelyistä ja ilmoitusten sisällöstä.

42 c § (28.2.2020/89) Notification to the police of the identification data of a weapon and its parts

The holder of a firearms licence must notify the police within 30 days of acquiring, borrowing, manufacturing or modifying a firearm or part thereof. The notification shall be made in writing or by electronic means as referred to in Article 119a.

The notification shall include:

1) the identification data of the firearm, the high-powered air weapon and the part of the weapon;

2) the name, address and date of birth of the transferor and transferee;

3) the name of the person ordering the repair or conversion;

(4) the name, address and date of birth of the lender and the borrower of the firearm, high-powered air weapon or firearm component;

5) the information necessary to identify the custodian and the place of storage, if the firearm, an effective air weapon or parts of a firearm which can be assembled are stored, other than temporarily, in the manner referred to in Article 106(1)(2) with a holder of a licence other than the holder of the licence who is authorised to possess the firearm;

6) information on the modification of a firearm in the event of a change in the type, function or calibre of the firearm or its deactivation or destruction;

7) the date of acquisition, loan, manufacture or conversion.

The information referred to in paragraph 2 shall also be provided at the time of the transfer, loan or return of the firearm by the transfer or or the lender, if the transfer or or the lender is the holder of a firearms trade licence within the meaning of Article 20.

Paragraph 3 shall enter into force on 1 March 2024.

The lender of a firearm, an air weapon or a part of a firearm may refrain from making the declaration referred to in paragraph 1 if the weapon or part of a weapon is in the possession of the borrower for a period of not more than 30 days after the date of the loan.

A Government decree shall lay down more detailed provisions on the procedures for and the content of notifications of the identification data of firearms, high-powered air weapons and parts of firearms.
