Asealan elinkeinoluvan haltijan on elinkeinotoimintansa aikana ilmoitettava asetietojärjestelmään ampuma-aseen, tehokkaan ilma-aseen, kaasusumuttimen ja aseen osan yksilöintitiedot, esineen luovuttajan tai lainaksiantajan ja luovutuksensaajan tai lainaksisaajan nimi, osoite ja syntymäaika sekä esineen korjaamista tai muuntamista koskevan toimeksiannon antajan nimi ja osoite.

Asealan elinkeinoluvan haltijan on ilmoitettava myös hallussaan olevan ampuma-aseen muuntamisesta ja aseen deaktivoinnista ja hävittämisestä. Ilmoituksesta on käytävä ilmi ampuma-aseen ja aseen osan yksilöintitiedot ja niiden muutos sekä toimenpiteen ajankohta.

Asealan elinkeinoluvan haltijan on ilmoitettava yksilöintitiedot myös patruunoista ja erityisen vaarallisista ammuksista tai tallennettava tiedot 5 momentissa tarkoitettuun tiedostoon.

Edellä 1–3 momentissa tarkoitettu ilmoitus on tehtävä 119 a §:ssä tarkoitettua sähköistä asiointia käyttäen 10 päivän kuluessa siitä, kun asealan elinkeinoluvan haltija on vastaanottanut ilmoitettavan esineen tai luovuttanut sen. Ampuma-aseen ja sen osan yksilöintitietojen ilmoittamisesta esinettä luovutettaessa säädetään 42 c §:ssä. Ilmoitus luovutetuista patruunoista ja erityisen vaarallisista ammuksista tehdään luovutuksen yhteydessä.

Patruunoita ja erityisen vaarallisia ammuksia koskevaan tiedostoon on tallennettava esineen luovuttajan ja luovutuksensaajan nimi. Tiedostoon sisältyviä henkilötietoja saa luovuttaa vain 115 §:ssä tarkoitetulle valvontaviranomaiselle valvontatehtävää varten. Asealan elinkeinoluvan haltijan on vaadittaessa esitettävä tiedosto poliisille sekä luovutettava se lupaviranomaiselle, kun asealan elinkeinolupa raukeaa tai jos se peruutetaan. Tiedosto on säilytettävä vähintään 30 vuotta siihen viimeksi tehdyn merkinnän jälkeen ja se on hävitettävä sen jälkeen, kun viimeisen merkinnän tekemisestä on kulunut 50 vuotta.

Valtioneuvoston asetuksella annetaan tarkemmat säännökset ampuma-aseen, tehokkaan ilma-aseen, kaasusumuttimen, aseen osan, patruunoiden ja erityisten vaarallisten ammusten yksilöintitietojen ilmoittamisesta sekä tietojen tallentamisesta 5 momentissa tarkoitettuun tiedostoon ja niiden esittämisestä ja luovuttamisesta.

Asealan elinkeinoluvan haltija voi poiketa 1 momentissa tarkoitetusta ilmoitusvelvollisuudesta, jos ampuma-aseen tai aseen osan haltija on jättänyt ampuma-aseen tai aseen osan asealan elinkeinonharjoittajalle ja esine on asealan elinkeinoluvan haltijan hallussa enintään 10 päivää.

25 § (7.6.2019/724) Notification to the weapons information system and storage of data

In the course of his business, the holder of a firearms trade licence shall register in the Weapons Information System the identification data of the firearm, high-powered air weapon, gas atomizer and weapon component, the name, address and date of birth of the transferor or lender of the object and of the transferee or borrower, and the name and address of the person who ordered the repair or conversion of the object.

The holder of a firearms trade licence must also declare the conversion, deactivation and destruction of a firearm in his possession. The notification shall indicate the identification of the firearm and the part of the firearm and any modification thereof, as well as the date of the operation.

The holder of a firearms trade licence shall also notify the identification data of cartridges and particularly dangerous ammunition or shall record the data in the file referred to in paragraph 5.

The notification referred to in paragraphs 1 to 3 shall be made using the electronic means of communication referred to in Article 119a within 10 days of the date on which the holder of the professional weapons licence has received or surrendered the object to be notified. The notification of the identification data of the firearm and its component parts upon surrender of the object shall be governed by Section 42c. The declaration of surrendered cartridges and particularly dangerous ammunition shall be made at the time of surrender.

The name of the donor and of the transferee shall be entered in the file on cartridges and particularly dangerous ammunition. The personal data contained in the file may be disclosed only to the supervisory authority referred to in Article 115 for the purpose of the supervisory task. The holder of a firearms trade licence shall, on request, submit the file to the police and hand it over to the licensing authority when the firearms trade licence lapses or is revoked. The file must be kept for at least 30 years after the last entry and must be destroyed 50 years after the last entry.

A Government decree shall lay down more detailed provisions on the declaration of the identification data of firearms, high-powered air weapons, gas guns, parts of firearms, cartridges and special dangerous ammunition, as well as on the recording, presentation and disclosure of the data in the file referred to in paragraph 5.

The holder of a firearms trade licence may derogate from the obligation to notify referred to in paragraph 1 if the holder of the firearm or part of a firearm has left the firearm or part of a firearm with the gunsmith and the article is in the possession of the holder of the firearms trade licence for a period of not more than 10 days.
