20 § (7.6.2019/724) Asealan elinkeinolupa

Poliisihallitus antaa ja peruuttaa luvan asealan elinkeinon harjoittamiseen (asealan elinkeinolupa).

Asealan elinkeinolupa voidaan antaa 20 a §:ssä säädetyt edellytykset täyttävälle luonnolliselle henkilölle tai oikeushenkilölle, jos tämän elinkeinotoiminta koostuu kokonaan tai osittain yhdestä tai useammasta 14 §:ssä tarkoitetusta asealan elinkeinosta.

Jos elinkeinotoiminnassa on tarkoitus käsitellä tai säilyttää ampuma-aseita, aseen osia, patruunoita tai erityiseen vaarallisia ammuksia, asealan elinkeinoluvan antamisen edellytyksenä on lisäksi, että säilytystilojen sijaintipaikan poliisilaitos on hyväksynyt säilytystilat turvallisiksi ottaen huomioon hakijan asealan elinkeinotoiminnan luonne ja laajuus.

Asealan elinkeinoluvan myöntämisen edellytykset
Asealan elinkeinolupa voidaan myöntää luonnolliselle henkilölle, joka:

1) on täyttänyt 18 vuotta;
2) on elinkeinon harjoittamiseen oikeutettu;
3) ilmoittaa 26 §:ssä tarkoitetun Poliisihallituksen hyväksymän vastuuhenkilön;
4) terveydentilansa ja käyttäytymisensä puolesta on asealan elinkeinon harjoittamiseen sopiva;
5) omaa asealan elinkeinotoiminnan kannalta riittävän asiantuntemuksen;
6) ei ole konkurssissa ja jonka toimintakelpoisuutta ei ole rajoitettu; sekä
7) varallisuutensa puolesta kykenee huolehtimaan asealan elinkeinotoiminnasta hyvin.

Asealan elinkeinolupa voidaan myöntää oikeushenkilölle, jos:

1) se varallisuutensa puolesta kykenee huolehtimaan toiminnasta hyvin; sekä
2) sen hallintoelimiin kuuluvat henkilöt ja toimitusjohtaja sekä avoimessa yhtiössä yhtiömiehet ja kommandiittiyhtiössä vastuunalaiset yhtiömiehet täyttävät 1 momentin 1, 2, 4 ja 6 kohdassa säädetyt vaatimukset.

20 § (7.6.2019/724) Business licence for the arms trade

The Police Board shall issue and revoke a licence to carry on a trade in the field of arms (a trade in arms licence).

An arms trade licence may be granted to a natural person or legal person who fulfils the conditions laid down in Section 20a, if the business activity of that person consists wholly or partly of one or more of the arms trades referred to in Section 14.

If the business activity involves the handling or storage of firearms, parts of firearms, cartridges or ammunition of a particularly dangerous nature, the granting of a firearms business licence shall also be subject to the condition that the police department of the place where the storage facilities are located has approved the storage facilities as safe, taking into account the nature and scope of the applicant's firearms business.

20 a § (7.6.2019/724) Conditions for granting a business licence in the field of arms

An arms trade licence may be granted to a natural person who:

1) is at least 18 years of age;
2) is entitled to carry on a trade or business;
3) declares a responsible person approved by the Police Board as referred to in Section 26;
4) is fit and proper in health and conduct to carry on the business of arms;
5) possesses sufficient expertise for the conduct of the arms trade;
6) is not bankrupt and is not subject to any restriction on his capacity to act; and
7) is able, by virtue of his or her financial resources, to provide for the proper conduct of the profession of armourer.

An arms trade licence may be granted to a legal person if:

1) it is able to manage the activity well on the basis of its assets; and
2) the members of its management bodies and the managing director, and, in the case of a general partnership, the general partners and, in the case of a limited partnership, the general partners, meet the requirements laid down in paragraphs 1(1), (2), (4) and (6).
