4. § (1) * A lőfegyver, a lőfegyverdarab, a lőszer (lőszerelem), a flóbert töltény, a festéklövő fegyver, a gáz- és riasztófegyver, a gáztöltény, a riasztótöltény, a vaktöltény, a légfegyver, a muzeális fegyver gyártását, a Magyarország területén történő forgalmazását, a lőfegyver, a lőszer (lőszerelem) kereskedelmi célú kivitelét, behozatalát a tevékenység helye, az ország területén történő átszállítását a Magyarország területére történő határátlépés helye szerint illetékes megyei (fővárosi) rendőr-főkapitányság engedélyezi.

(1a) * Az ügyfél erre irányuló kifejezett kérelme esetén - a (2) bekezdésben foglaltaktól eltérően - a lőfegyver gyártásának, illetve forgalmazásának engedélyezésére jogosult megyei (fővárosi) rendőr-főkapitányság engedélyezi a lőfegyver gyártására, illetve forgalmazására feljogosított készletében meglévő lőfegyver hatástalanítását.

(2) * E rendelet eltérő rendelkezése hiányában a lőfegyver, a lőfegyverdarab, a lőszer, a lőszerelem javítását és tartását, a házilagos lőszerszerelést és -újratöltést, a légfegyver javítását, a gáz- és riasztófegyver viselését, a lőfegyver hatástalanítását, a muzeális fegyver javítását és sportlövészeti célú használatát, az elöltöltő fegyver vadászati célú használatát, a polgári rendeltetésű lőtér, a lőfegyver- és lőszer (lőszerelem) tárolóhely üzemeltetését, a lövészetvezetői tevékenység végzését a kérelmező lakóhelye - ennek hiányában a lőfegyver tartása esetében a lőfegyver, lőszer tárolásának a helye, az elöltöltő fegyver vadászati célú használata esetében a lőszerelem tárolóhelye -, szervezet esetén a tevékenység helye szerint illetékes rendőrkapitányság, Budapesten a Budapesti Rendőr-főkapitányság engedélyezi.

(2a) * Az Ftv. 3. § (1) bekezdésében meghatározott azon tevékenységek végzését, amelyeknek az esetében a (2) bekezdés rendelkezései a kérelmező lakóhelyének vagy a tárolásra vonatkozó jogszabályi követelményeknek hiányában nem alkalmazhatóak, az a rendőrkapitányság engedélyezi, amelyiknél a kérelmét a kérelmező előterjesztette.

(3) * A 28. § (3) és (4) bekezdésében, valamint a 31. § (1) bekezdésében meghatározott szervezet számára az „A" kategóriába tartozó tűzfegyver tartását a tevékenység helye szerint illetékes megyei (fővárosi) rendőr-főkapitányság engedélyezi.

(4) * A lőfegyver és a hozzá tartozó lőszer önvédelmi vagy személy- és vagyonvédelmi célra történő tartását, a tárolásukra szolgáló tárolóhely üzemeltetését, az önvédelmi vagy személy- és vagyonvédelmi célra tartott lőfegyver hatástalanítását, a lőfegyver kiállítását, valamint a hangtompító tartását a kérelmező lakóhelye, szervezet esetén a tevékenység helye szerint illetékes megyei (fővárosi) rendőr-főkapitányság engedélyezi.

(5) Az európai lőfegyvertartási engedély kiadása és a lőfegyver, lőszer nem kereskedelmi célú kivitele a (2)-(4) bekezdésben meghatározott hatóság hatáskörébe tartozik.

4. § (1) * The manufacture and distribution of firearms, firearm parts, ammunition (ammunition), flintlock cartridges, paint guns, gas and alarm guns, gas cartridges, alarm cartridges, blank cartridges, air weapons, and museum weapons in the territory of Hungary, the export and import of firearms and ammunition (ammunition) for commercial purposes is authorised by the county (capital) police headquarters competent for the place of activity, and the transit of such firearms and ammunition (ammunition) through the territory of Hungary.

(1a) * In the case of an express request to this effect by the customer, the county (capital) police headquarters authorised to authorise the manufacture or distribution of firearms shall, notwithstanding paragraph (2), authorise the deactivation of firearms in the stock of the person authorised to manufacture or distribute firearms.

(2) * Unless otherwise provided for in this Ordinance, the repair and keeping of firearms, firearm parts, ammunition, ammunition, the home firing and reloading of firearms, the repair of air weapons, the carrying of gas and alarm weapons, the disarming of firearms, the repair and use of a muzzle-loading gun for sport shooting purposes, the use of a muzzle-loading gun for hunting purposes, and the use of a civilian shooting range, the operation of firearms and ammunition (ammunition) storage facilities, the exercise of the activity of a shooting instructor shall be licensed by the applicant's place of residence - in the absence of such a place, in the case of firearms and ammunition storage, in the case of the use of a firearm for hunting purposes, the ammunition storage facility - or, in the case of an organisation, by the police headquarters competent for the place of activity, in Budapest by the Budapest Police Headquarters.

(2a) * The carrying out of the activities specified in Article 3(1) of the Firearms Act, for which the provisions of paragraph (2) are not applicable due to the applicant's place of residence or the legal requirements for storage, shall be authorised by the police headquarters where the application was submitted.

(3) * The holding of firearms of category "A" by an organisation as defined in Article 28 (3) and (4) and Article 31 (1) shall be authorised by the county (capital) police headquarters competent for the place of activity.

(4) * The holding of firearms and ammunition for self-defence or personal and property protection purposes, the operation of a storage facility for their storage, the disarming of firearms held for self-defence or personal and property protection purposes, the issuing of firearms and the holding of silencers shall be authorised by the county (capital) police headquarters competent for the place of activity in the case of the applicant's place of residence or, in the case of an organisation, the county (capital) police headquarters competent for the place of activity.

(5) The issue of a European firearms licence and the export of firearms and ammunition for non-commercial purposes shall be the responsibility of the authority specified in paragraphs (2) to (4).
