Άρθρο 1

Διαδικασία χαρακτηρισμού όπλων και λοιπών αντικειμένων

1.Οι διοικούντες αξιωματικοί οφείλουν να προβαίνουν τουλάχιστον μια (1) φορά ανά έτος, σε επιθεώρηση των Υπηρεσιών ευθύνης τους, προς έλεγχο των κατεχόμενων και μη χρησιμοποιούμενων όπλων, καθώς και λοιπών αντικειμένων του ν. 2168/1993 (Α' 147), που έχουν εγγραφεί στο υλικό της Ελληνικής Αστυνομίας, προς εντοπισμό εκείνων που κατά την κρίση τους, μπορούν να χαρακτηρισθούν ως πλεονάζοντα και μη αναγκαιούντα ή πεπαλαιωμένα, μη δυνάμενα να χρησιμοποιηθούν πλέον για την κάλυψη επιχειρησιακών αναγκών και ενημερώνουν εγγράφως τη Μερική και Γενική Διαχείριση στην οποία υπάγονται.

2.α. Η προϊστάμενη Υπηρεσία της Διαχείρισης, συγκροτεί πενταμελή επιτροπή, η οποία αποφαίνεται διά πρακτικού ποια από αυτά κρίνονται μη κατάλληλα για την κάλυψη υπηρεσιακών αναγκών, σύμφωνα με το παράρτημα Ι της παρούσης, στο οποίο περιλαμβάνονται κατ' ελάχιστο τα στοιχεία ιχνηλασιμότητας του όπλου, ήτοι ο μοναδικός αριθμός, το είδος (πιστόλι, περίστροφο κ.α.), το εργοστάσιο κατασκευής, ο τύπος (αυτόματο, ημιαυτόματο κ.α.), το διαμέτρημα και η εν γένει κατάσταση του όπλου και των ουσιωδών συστατικών μερών αυτού ή τα ειδικότερα στοιχεία των λοιπών αντικειμένων του ν. 2168/1993. Τα εν λόγω είδη καταχωρούνται στο πρακτικό κατά κωδικό αριθμό του Γενικού Ονομαστικού. Η εν λόγω επιτροπή έχει πρόεδρο ανώτερο αξιωματικό, το δε ένα τουλάχιστον μέλος της φέρει ειδικότητα ή έχει γνώσεις οπλουργού.

β. Επί του πρακτικού αυτού γνωμοδοτεί ο προϊστάμενος της Γενικής Διαχείρισης, καθώς και το Οικονομικό Συμβούλιο αυτής, λαμβάνοντας υπόψη κάθε σχετικό έγγραφο που αφορά στη διατήρηση ειδών οπλισμού για την αντιμετώπιση εκτάκτων αναγκών. Επί του πρακτικού γνωμοδοτούν και οι Διευθύνσεις Τεχνικής Υποστήριξης και Ιστορίας του Αρχηγείου της Ελληνικής Αστυνομίας.

3.Το ως άνω πρακτικό υποβάλλεται εντός μηνός από τη σύνταξή του στη Διεύθυνση Υποστήριξης του Αρχηγείου της Ελληνικής Αστυνομίας, η οποία μεριμνά για την κοστολόγηση των καταγεγραμμένων σε αυτό όπλων και λοιπών αντικειμένων του ν. 2168/1993.

4.Για την κοστολόγηση των όπλων και λοιπών αντικειμένων του ν. 2168/1993 συγκροτείται με μέριμνα της Διεύθυνσης Υποστήριξης του Αρχηγείου της Ελληνικής Αστυνομίας τριμελής επιτροπή, με ετήσια διάρκεια, με πρόεδρο ανώτερο αξιωματικό, το δε ένα τουλάχιστον μέλος της να φέρει ειδικότητα ή να έχει γνώσεις οπλουργού, η οποία αποφαίνεται δια πρακτικού ως προς την αξία αυτών.

5.Ακολούθως και με βάση τα πρακτικά των παρ. 2 και 4, η Διεύθυνση Υποστήριξης του Αρχηγείου της Ελληνικής Αστυνομίας μεριμνά για την έκδοση απόφασης χαρακτηρισμού και κοστολόγησης μη επιχειρησιακά αξιοποιήσιμων όπλων και λοιπών αντικειμένων του ν. 2168/1993 του Προϊστάμενου Κλάδου Διαχειριστικής - Τεχνικής Υποστήριξης και Πληροφορικής του Αρχηγείου της Ελληνικής Αστυνομίας.

6.Η εν λόγω απόφαση κοινοποιείται στη Γενική Διαχείριση της Υπηρεσίας επιπέδου Διεύθυνσης Αστυνομίας ή εξομοιούμενης με αυτή Υπηρεσίας, στην οποία ανήκουν τα όπλα και λοιπά αντικείμενα του ν. 2168/1993, καθώς και στη Διεύθυνση Τεχνικής Υποστήριξης του Αρχηγείου της Ελληνικής Αστυνομίας, η οποία μεριμνά για την έκδοση διαταγής ανακατανομής τους, κατά περίπτωση.

Άρθρο 2

Κατηγορίες χαρακτηρισμού όπλων και λοιπών αντικειμένων του ν. 2168/1993

Τα κατεχόμενα όπλα και τα λοιπά αντικείμενα του ν. 2168/1993, που ανήκουν στο υλικό της Ελληνικής Αστυνομίας, χαρακτηρίζονται ως:

Α. Εύχρηστα - Χρεωθέντα.

Β. Εύχρηστα - Αποθήκη.

Γ. Άχρηστα - Εκποιήσιμα.

Δ. Άχρηστα - Καταστρεπτέα.

Ε. Συλλεκτικά - Ιστορικά κειμήλια, σύμφωνα με την υπό στοιχεία 3009/2/84-δ'/27-07-2004 απόφαση (Β' 1208), όπως έχει τροποποιηθεί και ισχύει.
Άρθρο 3

Χειρισμός χαρακτηρισθέντων όπλων και λοιπών αντικειμένων του ν. 2168/1993

1. Μετά την έκδοση απόφασης χαρακτηρισμού και κοστολόγησης των μη επιχειρησιακά αξιοποιήσιμων όπλων και λοιπών αντικειμένων του ν. 2168/1993, η Διεύθυνση Τεχνικής Υποστήριξης του Αρχηγείου της Ελληνικής Αστυνομίας διατάσσει την ανακατανομή τους και τη συγκέντρωσή τους στη Διεύθυνση Τεχνικών Εφαρμογών του Αρχηγείου της Ελληνικής Αστυνομίας, εφόσον χαρακτηρισθούν ως Άχρηστα - Εκποιήσιμα ή Άχρηστα - Καταστρεπτέα. Εφόσον χαρακτηρισθούν ως Συλλεκτικά- Ιστορικά κειμήλια, η Διεύθυνση Τεχνικής Υποστήριξης του Αρχηγείου της Ελληνικής Αστυνομίας αποστέλλει το σύνολο της αλληλογραφίας στη Διεύθυνση Ιστορίας του Αρχηγείου της Ελληνικής Αστυνομίας, για περαιτέρω χειρισμό σύμφωνα με την παρ. 4 του παρόντος.

2.Τα Άχρηστα - Εκποιήσιμα παραδίδονται από τη Διεύθυνση Τεχνικών Εφαρμογών του Αρχηγείου της Ελληνικής Αστυνομίας στο πλησιέστερο Ανεφοδιαστικό Όργανο του Στρατού Ξηράς, όπου συντάσσεται σχετικό πρακτικό παράδοσης-παραλαβής, μέχρις ότου ολοκληρωθούν οι ανάλογες διαδικασίες, από τις αρμόδιες Υπηρεσίες του Στρατού Ξηράς, σύμφωνα με τις ισχύουσες διατάξεις περί εκποίησης των πάσης φύσεως πλεοναζόντων και μη αναγκαιούντων ή πεπαλαιωμένων κινητών πραγμάτων της Ελληνικής Αστυνομίας.

Πριν την παράδοσή τους εκδίδεται, με μέριμνα της Διεύθυνσης Τεχνικών Εφαρμογών του Αρχηγείου της Ελληνικής Αστυνομίας, η οριζόμενη από τις ισχύουσες διατάξεις βεβαίωση από υπηρεσιακό οπλουργό, ως προς την ύπαρξη σήμανσης επ' αυτού, όπου προβλέπεται. Σε περίπτωση μη ύπαρξης σήμανσης, αυτή τοποθετείται, όπου προβλέπεται, με μέριμνα της Διεύθυνσης Τεχνικών Εφαρμογών του Αρχηγείου της Ελληνικής Αστυνομίας από τις οντότητες σήμανσης πυροβόλων όπλων και ουσιωδών συστατικών μερών, ως ορίζεται στην ισχύουσα νομοθεσία.

3.Τα Άχρηστα - Καταστρεπτέα υλικά - αντικείμενα (σκραπ), παραδίδονται από τη Διεύθυνση Τεχνικών Εφαρμογών του Αρχηγείου της Ελληνικής Αστυνομίας σε φυσικά ή νομικά πρόσωπα που διατηρούν αδειοδοτημένες επιχειρήσεις ανακύκλωσης (σκραπ), μέσω πλειοδοτικού διαγωνισμού, με ανταποδοτική είσπραξη σε είδος, κατ' ελάχιστο ίσης αξίας με τα εν λόγω υλικά, το οποίο να πληροί τις ελάχιστες τεχνικές προδιαγραφές της Υπηρεσίας. Η παράδοση των υλικών υλοποιείται μετά την οριστική ποιοτική και ποσοτική παραλαβή του ανταποδοτικού είδους, συντασσομένου προς τούτο σχετικού πρακτικού. Ο πλειοδότης τα παραλαμβάνει και τα καταστρέφει αυθημερόν, παρουσία πενταμελούς επιτροπής, η οποία συγκροτείται με Απόφαση του Προϊσταμένου Κλάδου Διαχειριστικής - Τεχνικής Υποστήριξης και Πληροφορικής του Αρχηγείου της Ελληνικής Αστυνομίας και απαρτίζεται από τρεις (3) αξιωματικούς και δυο (2) υπηρεσιακούς οπλουργούς, συντάσσοντας προς τούτο σχετικό πρακτικό, το οποίο προσυπογράφεται και από τον πλειοδότη. Οι ακολουθητέες διαδικασίες και οι λεπτομέρειες διενέργειας πλειοδοτικού διαγωνισμού ρυθμίζονται με διαταγή του Προϊσταμένου Κλάδου Διαχειριστικής - Τεχνικής Υποστήριξης και Πληροφορικής του Αρχηγείου της Ελληνικής Αστυνομίας.

4.Η Διεύθυνση Ιστορίας του Αρχηγείου της Ελληνικής Αστυνομίας προτείνει την ανακατανομή ή τη φύλαξη των Συλλεκτικών - Ιστορικών κειμηλίων ή διατάσσει την έκθεσή τους στις Μόνιμες Εκθέσεις Αστυνομικών Κειμηλίων ανά την Επικράτεια. Οποιαδήποτε διαδικασία ανακατανομής, φύλαξης ή έκθεσης υλοποιείται μετά την απενεργοποίησή τους, όπου προβλέπεται, από τις οριζόμενες στην ισχύουσα νομοθεσία οντότητες απενεργοποίησης και την πιστοποίηση αυτής από δημόσια αρχή επαλήθευσης, με μέριμνα των Υπηρεσιών που τα κατέχουν.

Όπλα και λοιπά αντικείμενα της παρούσης, τα οποία έχουν χαρακτηρισθεί ως Συλλεκτικά - Ιστορικά κειμήλια, δύναται να εκποιηθούν σύμφωνα με την υπό στοιχεία 8018/1/457-α'/18/12/2012 κοινή υπουργική απόφαση (Β' 3398), κατόπιν εισήγησης της Διεύθυνσης Ιστορίας του Αρχηγείου της Ελληνικής Αστυνομίας και απόφασης του Αρχηγού της Ελληνικής Αστυνομίας.

5.Όπλα, πυροβόλα όπλα ή ουσιώδη συστατικά μέρη αυτών και λοιπά αντικείμενα του ν. 2168/1993 (Α'147), τα οποία έχουν χαρακτηρισθεί ως Άχρηστα - Εκποιήσιμα ή Άχρηστα - Καταστρεπτέα ή Συλλεκτικά - Ιστορικά κειμήλια δύναται να παραχωρηθούν σε Υπηρεσίες του Δημόσιου ή ευρύτερου δημόσιου τομέα, κατόπιν απόφασης του Αρχηγού της Ελληνικής Αστυνομίας, με καταβολή ανταλλάγματος σε αντίστοιχο ή συναφές είδος, κατ' ελάχιστο ίσης αξίας, το οποίο να πληροί τις ελάχιστες τεχνικές προδιαγραφές της Υπηρεσίας. Η παράδοσή τους υλοποιείται μετά την οριστική, ποιοτική και ποσοτική παραλαβή του ανταποδοτικού είδους από πενταμελή Επιτροπή, η οποία συγκροτείται με Απόφαση του Προϊσταμένου Κλάδου Διαχειριστικής - Τεχνικής Υποστήριξης και Πληροφορικής του Αρχηγείου της Ελληνικής Αστυνομίας, αποτελούμενη από τρεις (3) αξιωματικούς και δυο (2) υπηρεσιακούς οπλουργούς, συντασσομένων προς τούτο σχετικών πρακτικών.

6.Όλα τα πρακτικά υποβάλλονται μετά τη σύνταξή τους στις Διευθύνσεις Υποστήριξης και Τεχνικής Υποστήριξης του Αρχηγείου της Ελληνικής Αστυνομίας, για διαχειριστική τακτοποίηση και ολοκλήρωση των διαδικασιών εγγραφοδιαγραφής.

7.Τα ανταποδοτικά είδη, η ποσότητα αυτών και οι τεχνικές προδιαγραφές καθορίζονται από τη Διεύθυνση Τεχνικής Υποστήριξης του Αρχηγείου της Ελληνικής Αστυνομίας, πριν την πλειοδοτική διαδικασία ή την έκδοση της σχετικής απόφασης της παραγράφου 5, κατά περίπτωση.

8.Για τη σήμανση, απόκτηση και κατοχή των όπλων και λοιπών αντικειμένων του ν. 2168/1993 (Α' 147), λόγω εκποίησης ή προσφοράς σε ανταπόδοση δωρεάς σε φυσικά ή νομικά πρόσωπα, εφαρμόζονται οι διατάξεις του ν. 2168/1993 (Α' 147) και των κατ' εξουσιοδότηση αυτού υπουργικών αποφάσεων.

Άρθρο 4

Ηλεκτρονική παρακολούθηση όπλων

Για την παρακολούθηση του συνόλου των όπλων της Ελληνικής Αστυνομίας τηρείται, πέραν των βιβλίων υλικού, ηλεκτρονική μηχανογραφική εφαρμογή υπηρεσιακού οπλισμού (P.O.L.) της Διεύθυνσης Πληροφορικής του Αρχηγείου της Ελληνικής Αστυνομίας, η οποία ενημερώνεται με μέριμνα των Γενικών Διαχειρίσεων των Υπηρεσιών που κατέχουν αυτά, περιλαμβάνοντας όλα τα στοιχεία ιχνηλασιμότητας, όπως μοναδικό σειριακό αριθμό, εργοστάσιο κατασκευής, είδος, τύπο, διαμέτρημα. Στην εν λόγω εφαρμογή τηρείται πλήρες ιστορικό ανά όπλο (κατανομή, ανακατανομές, χρεώσεις κ.α.) και τουλάχιστον μια φωτογραφία αυτού, μετά την εγγραφή του στο υλικό της Ελληνικής Αστυνομίας, έως και τη διαγραφή αυτού, ενώ περιλαμβάνονται και τα στοιχεία ιδιοκτήτη στην περίπτωση εκποίησης ή προσφοράς σε ανταπόδοση δωρεάς ή τα στοιχεία του πλειοδότη καταστροφής ή τα στοιχεία της Υπηρεσίας παραχώρησης ή της Υπηρεσίας φύλαξης ως συλλεκτικά - ιστορικά κειμήλια.

Η παρακολούθηση της ορθής ενημέρωσης αυτής και η έκδοση ειδικότερων οδηγιών υλοποιείται με μέριμνα της Διεύθυνσης Τεχνικής Υποστήριξης του Αρχηγείου της Ελληνικής Αστυνομίας.

Άρθρο 5

Μεταβατικές διατάξεις

Το έργο των επιτροπών του άρθρου 1, πρέπει να έχει ολοκληρωθεί για τα εγγεγραμμένα, έως την ημερομηνία δημοσίευσης της παρούσης, όπλα και λοιπά αντικείμενα του ν. 2168/1993 (Α' 147), στο υλικό της Ελληνικής Αστυνομίας, εντός δυο (2) ετών από την ημερομηνία δημοσίευσης της παρούσας.

Άρθρο 6

Καταργούμενες διατάξεις

Από την έκδοση της παρούσης καταργείται κάθε άλλη αντίθετη διάταξη, η οποία ρυθμίζει διαφορετικά την εκποίηση ή καταστροφή όπλων και λοιπών αντικειμένων που εμπίπτουν στις διατάξεις του ν. 2168/1993, έχουν περιέλθει με οποιονδήποτε τρόπο στην Ελληνική Αστυνομία και έχουν εγγραφεί στο υλικό της.

Article 1

Procedure for the classification of weapons and other objects

4. 2168/1993, a three-member committee shall be formed under the supervision of the Support Directorate of the Headquarters of the Hellenic Police, with an annual term, chaired by a senior officer, at least one member of which must be a specialist or have the knowledge of a gunsmith, and which shall decide on the value of such weapons and other items.

5. 2 and 4, the Support Directorate of the Headquarters of the Hellenic Police ensures the issuance of a decision on the classification and valuation of weapons and other objects of the law that are not operationally usable. 2168/1993 of the Head of the Management - Technical Support and Information Technology Branch of the Hellenic Police Headquarters.

6.This decision is notified to the General Management of the Police Directorate or similar service, to which the weapons and other objects of Law 21686868 belong. 2168/1993, as well as to the Technical Support Directorate of the Headquarters of the Hellenic Police, which shall ensure the issuance of a reallocation order, if applicable.

Article 2 Categories of classification of weapons and other objects of Law No. 2168/1993

Seized weapons and other objects of Law No. 2168/1993, belonging to the material of the Hellenic Police, are classified as:

Α. 21.1.1.

Β. Billed as "Billed".

Γ. Useless - Disposable.

D. Useless - Destructible.

Ε. Collectible - Historical relics, in accordance with the decision under items 3009/2/84-d'/27-07-2004 (B' 1208), as amended and in force.
Article 3

Handling of designated weapons and other objects of Law No. 2168/1993

1. Following the adoption of a decision on the classification and costing of weapons and other objects of Law No. 2168/1993, the Technical Support Directorate of the Hellenic Police Headquarters shall order their redistribution and collection at the Technical Applications Directorate of the Hellenic Police Headquarters, if they are classified as Useless - Disposable or Useless - Destructible. If they are classified as Collectible-Historical relics, the Technical Support Directorate of the Hellenic Police Headquarters sends all correspondence to the History Directorate of the Hellenic Police Headquarters for further handling in accordance with par. 4 of the present.

2. The Useless - Disposable items are delivered by the Technical Applications Directorate of the Hellenic Police Headquarters to the nearest Land Army Supply Body, where a relevant handover-acceptance report is drawn up, until the relevant procedures are completed by the competent Land Army Services, in accordance with the applicable provisions on the disposal of all kinds of surplus and non-essential or obsolete movable property of the Hellenic Police.

Prior to their delivery, the Directorate of Technical Applications of the Headquarters of the Hellenic Police issues, under the responsibility of the Directorate of Technical Applications, the certificate stipulated by the applicable provisions, issued by a service armourer, as to the existence of markings on them, where provided for. In the absence of marking, it shall be affixed, where provided, by the Technical Applications Directorate of the Hellenic Police Headquarters, by the firearms and essential component parts marking entities, as specified in the legislation in force.

3.The Waste - Destructible materials - objects (scrap), are delivered by the Technical Applications Directorate of the Hellenic Police Headquarters to natural or legal persons who maintain licensed recycling businesses (scrap), through a bidding process, with a return in kind, at least equal in value to the materials in question, which meets the minimum technical specifications of the Service. Delivery of the materials shall be effected after final qualitative and quantitative acceptance of the goods in return, following the drawing up of a report to that effect. The bidder receives and destroys them on the same day, in the presence of a five-member committee, which is formed by decision of the Head of the Branch of Management - Technical Support and Information Technology of the Hellenic Police Headquarters and consists of three (3) officers and two (2) service armourers, drawing up a relevant protocol, which is signed by the bidder. The procedures to be followed and the details of the bidding process are regulated by an order of the Head of the Management - Technical Support and Information Technology Branch of the Hellenic Police Headquarters.

4.The History Directorate of the Hellenic Police Headquarters proposes the redistribution or the storage of the Collectors' - Historical relics or orders their exhibition at the Permanent Exhibitions of Police Relics throughout the Territory. Any redistribution, storage or exhibition process shall be carried out after their deactivation, where provided for, by the deactivation entities designated in the legislation in force and the certification thereof by a public verification authority, at the discretion of the Services holding them.

Weapons and other objects of the present, which have been classified as Collector's - Historical relics, may be disposed of in accordance with the Joint Ministerial Decision (B' 3398) under item 8018/1/457-a'/18/12/2012, following the recommendation of the History Directorate of the Hellenic Police Headquarters and a decision of the Chief of the Hellenic Police.

5. 2168/1993 (A'147), which have been classified as Useless - Disposable or Useless - Destructible or Collectible - Historical relics may be granted to Services of the Public or wider public sector, following a decision of the Chief of the Hellenic Police, with payment of a consideration in a corresponding or related item, at least of equal value, which meets the minimum technical specifications of the Service. Their delivery is carried out after the final, qualitative and quantitative acceptance of the item in return by a five-member Committee, which is constituted by decision of the Head of the Branch of Management - Technical Support and Information Technology of the Hellenic Police Headquarters, consisting of three (3) officers and two (2) service armourers, with relevant minutes drawn up for this purpose.

6.All minutes shall be submitted after their drafting to the Support and Technical Support Directorates of the Hellenic Police Headquarters, for administrative arrangement and completion of the record-keeping procedures.

7.The items, their quantity and technical specifications are determined by the Technical Support Directorate of the Hellenic Police Headquarters, prior to the bidding procedure or the issuance of the relevant decision of paragraph 5, as the case may be.

8. 2168/1993 (A' 147), due to sale or offer in return for a donation to natural or legal persons, the provisions of Law No. 8.8. 2168/1993 (A' 147) and the ministerial decisions delegated by it.

Article 4 Electronic monitoring of weapons

For the tracking of all the weapons of the Hellenic Police, in addition to the material books, an electronic computerized application of service weapons (P.O.L.) of the Information Technology Directorate of the Hellenic Police Headquarters is kept, which is updated by the General Administrations of the Services holding them, including all traceability data, such as unique serial number, factory of manufacture, type, type, caliber. In this application, a complete history per weapon (allocation, reallocations, charges, etc.) and at least one photograph of it is kept, after its registration in the material of the Hellenic Police, until its deletion, while the owner's data in case of sale or offer in return for a donation or the data of the bidder of destruction or the data of the Concession Service or the Custody Service as collector's - historical relics are also included.

The monitoring of the correct updating of this information and the issuing of special instructions is carried out by the Technical Support Department of the Hellenic Police Headquarters.

Article 5 Transitional provisions

The work of the Committees of Article 1 must be completed for the weapons and other objects registered by the date of publication of this Law. 2168/1993 (A' 147), in the material of the Hellenic Police, within two (2) years from the date of publication of this publication.


Article 6 Repealed provisions

As of the adoption of the present Law, any other contrary provision, which otherwise regulates the sale or destruction of weapons and other objects covered by the provisions of Law No. 2168/1993, which have come into the possession of the Greek Police in any way and have been registered in its material.
