违反枪支管理规定，出租、出借枪支，情节轻微未构成犯罪的，由公安机关对个人或者单位负有直接责任的主管人员和其他直接责任人员处十五日以下拘留，可以并处五千元以下罚款；对出租、出借的枪支，应当予以没收。

第四十四条

违反本法规定，有下列行为之一的，由公安机关对个人或者单位负有直接责任的主管人员和其他直接责任人员处警告或者十五日以下拘留；构成犯罪的，依法追究刑事责任：

（一）未按照规定的技术标准制造民用枪支的；

（二）在禁止携带枪支的区域、场所携带枪支的；

（三）不上缴报废枪支的；

（四）枪支被盗、被抢或者丢失，不及时报告的；

（五）制造、销售仿真枪的。

有前款第（一）项至第（三）项所列行为的，没收其枪支，可以并处五千元以下罚款；有前款第（五）项所列行为的，由公安机关、工商行政管理部门按照各自职责范围没收其仿真枪，可以并处制造、销售金额五倍以下的罚款，情节严重的，由工商行政管理部门吊销营业执照。

Article 43

Individuals who deploy firearms for civilian use, in violation of firearm management regulations, rent or lend firearms and cause serious consequences, shall be punished in accordance with the provisions of Article 163 of the Criminal Law.

If the violation of firearm management regulations, renting or lending firearms, and the circumstances are minor and do not constitute a crime, the person in charge of the public security organ directly responsible for the individual or unit and other persons directly responsible shall be detained for not more than 15 days and may be concurrently sentenced to not more than 5,000 yuan fines; firearms that are rented out or lent shall be confiscated.

Article 44:

Anyone who violates the provisions of this law and commits one of the following acts shall be given a warning or detained for less than 15 days by the public security organs directly responsible for individuals or units in charge and other persons directly responsible; if a crime is constituted, the law shall hold criminally responsible:

(1) Failing to manufacture civilian firearms in accordance with the prescribed technical standards;
(2) Carrying firearms in areas or places where firearms are prohibited;
(3) Failing to turn in scrap firearms;
(4) Failure to report the stolen, robbed or lost firearms in time;
(5) Manufacturing and selling imitation firearms.

Those who commit the acts listed in items (1) to (3) of the preceding paragraph shall have their firearms confiscated and may also be fined not more than 5,000 yuan; for the acts listed in item (5) of the preceding paragraph, the public security organs, industry and commerce. The administrative departments confiscate their simulated firearms in accordance with their respective scope of duties, and may concurrently impose a fine of less than five times the amount of manufacture and sales. If the circumstances are serious, the business licence shall be revoked by the administrative department for industry and commerce.
