国家对列入武器装备科研生产许可目录（以下简称许可目录）的武器装备科研生产活动实行许可管理。但是，专门的武器装备科学研究活动除外。

许可目录由国务院国防科技工业主管部门会同中国人民解放军总装备部（以下简称总装备部）和军工电子行业主管部门共同制定,并适时调整。许可目录的制定和调整，应当征求国务院有关部门和军队有关部门的意见。

武器装备科研生产许可，应当在许可目录所确定的范围内实行分类管理。

第三条　

未取得武器装备科研生产许可，不得从事许可目录所列的武器装备科研生产活动。但是，经国务院、中央军事委员会批准的除外。

第四条　武器装备科研生产许可管理，应当遵循统筹兼顾、合理布局、鼓励竞争、安全保密的原则。

Article 2

The state shall implement licensing management for weapons and equipment scientific research and production activities listed in the weapons and equipment scientific research and production licensing catalogue (hereinafter referred to as the licensing catalogue). However, special scientific research activities of weapons and equipment are excluded.

The licensing catalogue is formulated by the State Council's National Defence Science, Technology and Industry Department in conjunction with the Chinese People's Liberation Army General Armament Department (hereinafter referred to as the General Armament Department) and the military electronics industry department, and adjusted in due course. The formulation and adjustment of the permit catalogueue shall seek the opinions of the relevant departments of the State Council and the relevant military departments.

The licence for scientific research and production of weapons and equipment shall be subject to classified management within the scope specified in the licence catalogue.

Article 3:

Without obtaining a licence for scientific research and production of weapons and equipment, no one shall engage in the scientific research and production activities of weapons and equipment listed in the licensing catalogue. However, except those approved by the State Council and the Central Military Commission.
