Anzahl der erlaubten Waffen

§ 23. (1) Im Waffenpaß und in der Waffenbesitzkarte ist die Anzahl der Schusswaffen der Kategorie B, die der Berechtigte besitzen darf, festzusetzen.
Die Anzahl der Schusswaffen der Kategorie B, die der Berechtigte besitzen darf, ist mit zwei festzusetzen. Auf Antrag ist die Anzahl der Schusswaffen der Kategorie B, die der Berechtigte besitzen darf, auf höchstens fünf zu erhöhen, sofern seit der erstmaligen Festsetzung der Anzahl mindestens fünf Jahre vergangen sind. Unabhängig davon darf eine größere Anzahl, auch wenn eine weitere Bewilligung ausgestellt wird, nur erlaubt werden, sofern auch hierfür eine Rechtfertigung glaubhaft gemacht wird. Als solche Rechtfertigung gelten insbesondere die Ausübung der Jagd oder des Schießsports im Sinne des § 11b sowie das Sammeln von Schusswaffen. Bei der Festsetzung der Anzahl der Schusswaffen der Kategorie B gemäß dem zweiten Satz ist die Anzahl der Schusswaffen gemäß § 17 Abs. 1 Z 7, 8 und 11 sowie § 18, die der Betroffene besitzen darf, einzurechnen.

(2a) Schusswaffen der Kategorie B, deren Modell vor 1871 entwickelt wurde, und Schusswaffen der Kategorie B, die vor 1900 erzeugt wurden, sind in die von der Behörde festgelegte Anzahl nicht einzurechnen.
(2b) Beantragt der Inhaber einer Waffenbesitzkarte, mehr Schusswaffen der Kategorie B besitzen zu dürfen, als ihm bislang erlaubt war und liegt kein Grund vor, bereits gemäß Abs. 2 eine größere Anzahl zu bewilligen, so ist dem Mitglied eines Vereins gemäß § 3 VerG, dessen Zweck die Ausübung des Schießsports umfasst, eine um höchstens zwei größere aber insgesamt zehn Schusswaffen nicht übersteigende Anzahl zu bewilligen, wenn
seit der vorangegangenen Festsetzung der Anzahl mindestens fünf Jahre vergangen sind,
keine Übertretungen des Waffengesetzes 1996 vorliegen,
glaubhaft gemacht werden kann, dass für die sichere Verwahrung der größeren Anzahl an Schusswaffen Vorsorge getroffen wurde.
Bei der Festsetzung dieser Anzahl ist die Anzahl der Schusswaffen gemäß § 17 Abs. 1 Z 7, 8 und 11 sowie § 18, die der Berechtigte besitzen darf, einzurechnen.

(2c) Das Sammeln von Schusswaffen der Kategorie B kommt insoweit als Rechtfertigung in Betracht, als sich der Antragsteller mit dem Gegenstand der Sammlung und dem Umgang mit solchen Waffen vertraut erweist und außerdem nachweist, dass er für die sichere Verwahrung der Schusswaffen vorgesorgt hat.
Zusätzlich zu der in Abs. 1 festgesetzten Anzahl von Schusswaffen ist der Erwerb und Besitz der doppelten Anzahl an wesentlichen Bestandteilen von Schusswaffen der Kategorie B erlaubt. Darüber hinaus ist der Erwerb und Besitz von wesentlichen Bestandteilen nur auf Grund einer behördlichen Bewilligung unter den Voraussetzungen des § 21 Abs. 1 zulässig. Eine dafür erteilte Bewilligung ist durch einen zusätzlichen Vermerk im waffenrechtlichen Dokument zu kennzeichnen.

Section 4 Firearms of Category B

Number of permitted weapons

§ 23(1) The number of category B firearms that the person entitled may possess shall be specified in the firearms pass and the firearms possession card.
(2) The number of category B firearms that the person entitled may possess shall be set at two. On application, the number of category B firearms that the person entitled may possess may be increased to a maximum of five, provided that at least five years have elapsed since the number was first determined. Irrespective of this, a larger number may only be permitted, even if a further licence is issued, if credible justification is also provided for this. Such justification shall be deemed to be, in particular, the practice of hunting or shooting as defined in § 11b as well as the collection of firearms. When determining the number of firearms of category B pursuant to the second sentence, the number of firearms pursuant to section 17(1)(7), (8) and (11) and section 18 which the person concerned may possess shall be included.

(2a) Category B firearms whose model was developed before 1871 and Category B firearms produced before 1900 shall not be included in the number determined by the authority.

(2b) If the holder of a firearms possession card applies for the right to possess more Category B firearms than he/she was previously permitted to possess and if there is no reason to grant a larger number pursuant to subsection 2, the member of an association pursuant to section 3 of the VerG, the purpose of which includes the practice of shooting sports, shall be granted a number of firearms not exceeding two, but not exceeding a total of ten, if
1. at least five years have passed since the previous determination of the number,
2. no violations of the Weapons Act 1996 have been committed,
3. it can be credibly shown that provisions have been made for the safekeeping of the larger number of firearms.
In determining this number, the number of firearms pursuant to section 17(1)(7), (8) and (11) and section 18 which the person entitled may possess shall be included.
(2c) The collection of firearms of category B shall be considered as justification insofar as the applicant proves to be familiar with the object of the collection and the handling of such firearms and also proves that he has made provisions for the safekeeping of the firearms.
(3) In addition to the number of firearms specified in subsection (1), the acquisition and possession of twice the number of essential components of category B firearms shall be permitted. In addition, the acquisition and possession of essential components is only permitted on the basis of an official permit under the conditions of section 21(1). A permit granted for this purpose is to be marked by an additional note in the firearms law document.
