Articolo 23
Armi clandestine
Sono considerate clandestine:
1) le armi comuni da sparo non catalogate ai sensi del precedente articolo 7 ((, ovvero non sottoposte alla verifica di cui all'articolo 23, comma 12-sexiesdecies, del decreto-legge 6 luglio 2012, n. 95, convertito, con modificazioni, dalla legge 7 agosto 2012, n. 135;));
2) le armi comuni e le canne sprovviste dei numeri, dei contrassegni e delle sigle di cui al precedente articolo 11.
È punito con la reclusione da tre a dieci anni e con la multa da lire quattrocentomila a lire tre milioni chiunque fabbrica, introduce nello Stato, esporta, commercia, pone in vendita o altrimenti cede
armi o canne clandestine. (16)
Chiunque detiene armi o canne clandestine è punito con la reclusione da uno a sei anni e con la multa da lire duecentomila a lire due milioni. (16)
Si applica la pena della reclusione da due a otto anni e la multa da lire trecentomila a lire tre milioni a chiunque porta in luogo pubblico o aperto al pubblico armi o canne clandestine. La stessa pena si applica altresì a chiunque cancella, contraffa' o altera i numeri di catalogo o di matricola e gli altri segni distintivi di cui all'articolo 11. (16)
Con la sentenza di condanna è ordinata la revoca delle autorizzazioni di polizia in materia di armi e la confisca delle stesse armi. ((Non è punibile, ai sensi del presente articolo, per la mancanza
dei segni d'identificazione prescritti per le armi comuni da sparo, chiunque ne effettua il trasporto per la presentazione del prototipo al Banco nazionale di prova ai fini della sottoposizione alla verifica di cui all'articolo 23, comma 12-sexiesdecies, del decreto-legge 6 luglio 2012, n. 95, convertito, con modificazioni, dalla legge 7 agosto 2012, n. 135, o l'importazione ai sensi
dell'articolo 11.))

AGGIORNAMENTO (3a)
Il D.P.R. 16 dicembre 1986, n. 865, ha disposto (con l'art. 1, comma 1, lettera f)) che "E' concessa amnistia […] per il reato di cui al comma terzo dell'art. 23 della legge 18 aprile 1975, n. 110 (norme integrative della disciplina vigente per il controllo delle armi, delle munizioni e degli esplosivi), quando concerna armi la cui detenzione l'imputato o il condannato aveva denunciato all'autorità di pubblica sicurezza, nonché' per il reato di cui al comma decimo dell'art. 10 della citata legge, limitatamente alla sua applicazione alle fattispecie di cui ai commi sesto e ottavo dello stesso art. 10, allorché' il fatto, per la sua qualità e il numero limitato delle armi, debba ritenersi di lieve entità".
Ha inoltre disposto (con l'art. 12, comma 1) che "L'amnistia e l'indulto hanno efficacia per i reati commessi fino a tutto il giorno 8 giugno 1986".

AGGIORNAMENTO (4a)
Il D.P.R. 12 aprile 1990, n. 75, ha disposto (con l'art. 1, comma
1, lettera e)) che "E' concessa amnistia […] per il reato di cui al comma terzo dell'articolo 23 della legge 18 aprile 1975, n. 110 (norme integrative della disciplina vigente per il controllo delle armi, delle munizioni e degli esplosivi), quando concerne armi la cui detenzione l'imputato o il condannato aveva denunciato all'autorità di pubblica sicurezza".
Ha inoltre disposto (con l'art. 6, comma 1) che "L'amnistia ha efficacia per i reati commessi fino a tutto il giorno 24 ottobre 1989".

AGGIORNAMENTO (16)
Il D.Lgs. 26 ottobre 2010, n. 204 ha disposto (con l'art. 5, comma 1, lettera o)) che "all'articolo 23 sono apportate le seguenti modificazioni:
1) al secondo comma, le parole: "e con la multa da euro 206 a euro 1.549" sono sostituite dalle seguenti: "e con la multa da 2.000 euro a 20.000 euro";
2) al terzo comma, le parole: "e con la multa da euro 103 a euro 1032" sono sostituite dalle seguenti: "e con la multa da 1.000 euro a 15.000 euro";
3) al quarto comma, le parole: "e la multa da euro 154 a euro 1.549" sono sostituite dalle seguenti: "e con la multa da 2.000 euro a 20.000 euro""

Article 23
Illicit weapons
The following shall be regarded as Illicit:
1) common firearms not catalogued pursuant to Article 7 above ((, or not subject to the verification referred to in Article 23, paragraph 12-sexiesdecies, of Decree-Law No 95 of 6 July 2012, converted, with amendments, by Law No 135 of 7 August 2012;))
2) common arms and barrels lacking the numbers, markings and initials referred to in Article 11 above.
Anyone who manufactures, introduces into the State, exports, trades, offers for sale or otherwise disposes of Illicit arms or barrels. (16)
Whoever possesses Illicit weapons or barrels shall be punished with imprisonment from one to six years and with a fine ranging from two hundred thousand lire to two million lire. (16)
The punishment of imprisonment from two to eight years and a fine from three hundred thousand to three million lire shall be imposed on anyone who brings illegal weapons or barrels into a public place or a place open to the public. The same punishment shall also apply to anyone who deletes, counterfeits or alters the catalogue or serial numbers and other distinguishing marks referred to in Article 11. (16)
With the sentence of conviction, the revocation of police authorisations concerning weapons and the confiscation of the same weapons shall be ordered. ((It shall not be punishable, under this Article, for lacking the identification marks prescribed for common firearms, whoever transports them for the presentation of the prototype to the National Proof House for the purpose of the verification referred to in Article 23, paragraph 12-sexiesdecies, of Decree-Law No. 95 of 6 July 2012, converted, with amendments, by Law No. 135 of 7 August 2012, or imports them pursuant to
Article 11)).

UPDATE (3a)
The Presidential Decree no. 865 of 16 December 1986 provided (by Article 1, paragraph 1, letter f)) that "Amnesty […] is granted for the offence referred to in the third paragraph of Article 23 of Law no. 110 of 18 April 1975 (rules supplementing the regulations in force). 110 of 18 April 1975 (rules supplementing the regulations in force for the control of arms, ammunition and explosives), when it concerns arms whose possession the defendant or the convicted person had reported to the public security authority, as well as for the offence referred to in paragraph 10 of Art. It also provided (by Art. 10(10) of the Law) that the offence referred to in Art. 10(6) and (8) is to be regarded as a minor offence because of its quality and the limited number of weapons.
It has also provided (with Art. 12, paragraph 1) that "The amnesty and pardon are effective for crimes committed up to and including 8 June 1986".

UPDATE (4a)
Presidential Decree no. 75 of 12 April 1990 provided (by Article 1, paragraph
1, letter e)) that "Amnesty […] shall be granted for the offence referred to in the third paragraph of Article 23 of Law No 110 of 18 April 1975 (rules supplementing the regulations in force for the control of weapons, ammunition and explosives), when it concerns weapons the possession of which the accused or convicted person had reported to the public security authority".
It also provided (in Article 6(1)) that "The amnesty shall be effective for offences committed up to and including 24 October 1989".

Legislative Decree No 204 of 26 October 2010 provided (by Article 5, Paragraph 1, Letter o) that "Article 23 shall be amended as follows:
1) in the second paragraph, the words: 'and a fine from 206 euros to 1,549 euros' shall be replaced by the following: 'and a fine from 2,000 euros to 20,000 euros';
2) in the third paragraph, the words: "and with a fine from EUR 103 to EUR 1032" are replaced by the following: "and with a fine from EUR 1,000 to EUR 15,000";
3) in the fourth paragraph, the words: "and with a fine from 154 to 1,549 euros" are replaced by the following: "and with a fine from 2,000 to 20,000 euros"".
