Articolo 16
Esportazione di armi

Nelle operazioni concernenti le armi comuni da sparo di cui al precedente articolo 2 dichiarate per l'esportazione, sono obbligatori la visita doganale e il riscontro della guardia di finanza.

((Il rilascio della licenza di polizia, singola, multipla e globale, fatte salve le previsioni di cui all'articolo 1, comma 11, della legge 9 luglio 1990, n. 185, come modificata dal decreto legislativo 22 giugno 2012, n. 105, per l'esportazione di armi comuni da sparo di ogni tipo è subordinato all'applicazione del disposto dell'articolo 11 del regolamento (CE) n. 258/2012.)) ((PERIODO SOPPRESSO DAL D.LGS. 29 SETTEMBRE 2013, N. 121)).
((Il titolare)) della licenza di polizia deve esibire all'autorità che ha rilasciato la licenza la bolletta di esportazione, ovvero copia di
essa autenticata o vistata dall'autorità medesima.

Il contravventore all'obbligo di cui al precedente comma è punito a norma dell'articolo 17 del testo unico delle leggi di pubblica sicurezza 18 giugno 1931, n. 773, e successive modificazioni. Con decreto del Ministro per le finanze, di concerto col Ministro per l'interno, da pubblicarsi nella Gazzetta Ufficiale, sono
determinate le modalità per assicurare l'effettiva uscita dal territorio dello Stato delle armi destinate all'esportazione, nonché' quelle per disciplinare l'esportazione temporanea, da parte di persone residenti in Italia, di armi comuni da sparo per uso sportivo o di caccia ((, ovvero di armi comuni da sparo per finalità commerciali ai soli fini espositivi durante fiere, esposizioni, mostre, o di valutazione e riparazione)).

Con decreto del Ministro per l'interno, sentito il Ministro per i beni culturali, da pubblicarsi nella Gazzetta Ufficiale, sono determinate le modalità relative alla temporanea esportazione di armi antiche, artistiche, rare o comunque aventi importanza storica ai fini di mostre e scambi culturali.

Articolo 17
((Compravendita di armi comuni da sparo per corrispondenza o mediante contratto a distanza.

1. Ferme restando le vigenti disposizioni in materia di importazione, esportazione e trasferimenti intracomunitari di armi comuni da sparo, alle persone residenti nello Stato è consentita la compravendita di armi comuni da sparo commissionate per corrispondenza o acquistate in base a contratto a distanza, di cui all'articolo 45, comma 1, lettera g), del decreto legislativo 6 settembre 2005, n. 206, qualora l'acquirente sia autorizzato ad esercitare attività industriali o commerciali in materia di armi, ovvero, se privo delle predette autorizzazioni, provveda al ritiro dell'arma presso un titolare di licenza per il commercio di armi comuni da sparo o presso un intermediario di armi, muniti, rispettivamente, delle licenze di cui agli articoli 31 e 31-bis del regio decreto 18 giugno 1931, n. 773. Di ogni spedizione la ditta interessata deve dare comunicazione all'ufficio di pubblica sicurezza, o, in mancanza, al comando dei carabinieri del comune in cui risiede il destinatario.
2. I trasgressori sono puniti con la reclusione da uno a sei mesi e con la multa fino a euro 154.))

Article 16
Export of weapons

In transactions concerning common firearms referred to in Article 2 above declared for export, customs inspection and verification by the Guardia di Finanza shall be mandatory.

((The issuance of the police licence, single, multiple and global, without prejudice to the provisions of Article 1, paragraph 11, of Law No 185 of 9 July 1990, as amended by Legislative Decree No 105 of 22 June 2012, for the export of common firearms of any type is subject to the application of the provisions of Article 11 of Regulation (EC) No 258/2012.)) ((PERIOD DELETED BY LEGISLATIVE DECREE NO 121 OF 29 SEPTEMBER 2013)).

((The holder)) of the police licence must show the authority which issued the licence the export bill, or a copy thereof authenticated or stamped by the holder of the police licence must show the authority that issued the licence the export licence, or a copy thereof authenticated or stamped by that authority.

Any person infringing the obligation set out in the preceding paragraph shall be punished in accordance with Article 17 of the Consolidated Text of the laws on public security of 18 June 1931, No 773, and subsequent amendments. By decree of the Minister for Finance, in agreement with the Minister for the Interior, to be published in the Official Gazette, the following shall be established.

The procedures for ensuring the effective exit from the territory of the State of arms intended for export are determined, as well as those for regulating the temporary export, by persons resident in Italy, of common firearms for sporting or hunting use ((, or of common firearms for commercial purposes for the sole purpose of display during fairs, shows, exhibitions, or for evaluation and repair)).

By decree of the Minister for the Interior, after consultation with the Minister for Cultural Assets, to be published in the Official Gazette, the procedures relating to the temporary export of antique, artistic, rare or otherwise historically important weapons for the purposes of exhibitions and cultural exchanges shall be determined.

Article 17
((Buying and selling of common firearms by mail order or distance contract.

1. Without prejudice to the provisions in force concerning the import, export and intra-Community transfers of common firearms, persons resident in the State shall be allowed to buy and sell common firearms commissioned by mail order or purchased under a distance contract, as referred to in Article 45 (1) (g) of Legislative Decree No. 206 of 6 September 2005, if the purchaser is authorised to do so by the competent authority of the State. 206, if the purchaser is authorised to engage in industrial or commercial activities relating to weapons, or, if he does not have the aforementioned authorisations, he withdraws the weapon from a holder of a licence for the trade in common firearms or from an arms broker, with, respectively, the licences referred to in Articles 31 and 31-bis of Royal Decree No 773 of 18 June 1931. The firm concerned must notify the public security office or, failing that, the Carabinieri headquarters of the municipality in which the recipient resides of each shipment.
2. Offenders shall be punished with imprisonment from one to six months and a fine up to 154 euros)).
