Sous-section 2: Remise d'une arme à l'autorité administrative

Article R. 312-73

L'arme, les munitions et leurs éléments saisis définitivement par le préfet, dont l'acquisition et la détention ne sont pas prohibées, sont:

1° Soit vendus aux enchères publiques au profit de la personne à qui elles ont été saisies;
2° Soit cédés à un commerçant autorisé pour la catégorie de l'arme;
3° Soit remises à l'Etat si le détenteur manifeste son intention de renoncer au bénéfice des procédures mentionnées aux 1° et 2°.

Dans ce dernier cas, ainsi que dans celui d'absence d'adjudication lors de la vente, cette arme et ces munitions sont remises définitivement à l'Etat dans les conditions prévues par arrêté conjoint du ministre de la justice, du ministre chargé du budget, du ministre de l'intérieur et du ministre de la défense.

Sub-section 2: Handing Over a Firearm to the Administrative Authority

Article R. 312-73

Firearms, ammunition and their components, permanently seized by the Prefect, whose acquisition and possession are not prohibited:

1° Are sold in public auctions for the benefit of the individual from whom they were seized;
2° Are transferred to a dealer authorised for the category of the firearm;
3° Are surrendered to the State, if the holder manifests his intent to renounce to the benefit of procedure mentioned in 1° and 2°.

In this last case, as well as in case of absence of tender during the sale, the firearm and ammunition are permanently surrendered to the State, under conditions provided for by joint order of the Minister of Justice, Minister in charge of the Budget, Minister of the Interior and Minister of Defence.
