Articulo 39. Aptitudes Físicas y Psíquicas

Para la aplicación del numeral 4 del artículo 291 de la Ley, en ningún caso podrán tener licencias de armas de fuego las personas cuyas condiciones físicas o psíquicas les impidan su utilización o implique riesgo propio o ajeno.

Para estos propósitos, la autoridad de aplicación realizará las averiguaciones pertinentes en la comunidad acerca de las aptitudes del solicitante, la información se obtendrá mediante entrevista y referencias personales que se estimen convenientes. En base a los resultados de las averiguaciones, la autoridad de aplicación se reservará el derecho de otorgar o no la licencia solicitada.

De lo dispuesto en este apartado, se exceptúan a las misiones y funcionarios diplomáticos acreditados, teniendo presente el principio de reciprocidad.

Article 39. Physical and Psychological Abilities

For the implementation of paragraph 4 of Article 291 of the Act, individuals whose physical or psychological conditions prevent them from using firearms or imply a risk to themselves or to others may, under no circumstances, obtain a firearm licence.

For these purposes, the implementing authority shall carry out in the community the necessary inquiries on the abilities of the applicant, the information shall be obtained through interviews and personal references deemed appropriate. Based on the inquiries' results, the implementing authority reserves the right to grant or deny the requested licence.

Accredited diplomatic missions and officials shall be exempted from the above provisions, bearing in mind the principle of reciprocity.
