Articulo 24. Destino de las Armas Decomisadas

La autoridad de aplicación, en el caso de las armas de fuego, municiones y sus accesorios que por sentencia judicial firme o resolución administrativa sean decomisadas, siempre y cuando se encuentren aptas para el servicio policial, las pasará al inventario propiedad de la Policía Nacional. Las armas estrictamente militares, deben ser entregadas mediante acta al Ejército de Nicaragua.

Las armas que se encuentren en mal estado deberán ser destinadas para la destrucción mediante los procedimientos establecidos para estos efectos por la Ley, el presente Reglamento y normativas complementarias que se dicten.

La Policía Nacional y el Ejército de Nicaragua deberán reportar formalmente a la Dirección de Bienes del Estado, el listado de armas que se incorporen a sus inventarios para los efectos de registro y control.

Las armas propiedad del Ejército de Nicaragua, de la Policía Nacional y de otras dependencias del Estado, que hubieren sido ocupadas por efectos de la Ley, serán devueltas por la autoridad de aplicación, mediante acta, a las instituciones correspondientes.

Decree No. 28-2005, Regulation to the Special Act on the Control and Regulation of Firearms, Ammunition, Explosives and Other Related Materials

Article 24. Destination of Seized Firearms

The implementing authority, in the case of firearms, ammunition and their accessories that, by a final court judgment or administrative resolution, are seized, provided that they are fit for police service, shall go into the inventory of the National Police. Any strictly military firearm must be handed over through an act of Nicaragua's Army.

Any firearm found in bad condition are destined for destruction through the procedures established for these purposes by the Act, the present Regulation and dictated complementary norms.

The National Police and Nicaragua's Army must formally report to the Directorate of State Goods, the list of firearms to be added to their inventories for registration and control.

Firearms that are the property of Nicaragua's Army, the National Police and other State bodies, which have been collected in accordance with the Act, shall be returned by the implementing authority, through an act, to the corresponding institutions.
