Les armes légères et de petit calibre (ALPC) sont soumises, selon leur type, à la réglementation applicable pour l'exportation et l'importation de matériels de guerre et assimilés ou à la réglementation relative aux armes à feu.

Remarque: Pour la nomenclature des armes et leur classification voir la Loi n°2012-­304 du 6 mars 2012 "relative à l'établissement d'un contrôle des armes moderne, simplifié et préventif" (et son décret d'application: Décret n°2013-­700 du 30 juillet 2013); l'arrêté du 27 juin 2012 modifié par l'arrêté de 7 mars 2013 qui fixe la liste des matériels de guerre et assimiliés; et les articles 1 et 2 du Décret n°2014-­62 du 28 janvier 2014 pour les armes à feu et munitions.

1) Le régime applicable pour l'exportation et l'importation de matériels de guerre, armes et munitions ainsi que pour les transferts de produits liés à la défense est fixé par la Code de la défense et plus particulièrement:

L'exportation à destination d'Etats tiers à l'Union européenne et le transfert à destination d'Etats membres de l'Union européenne de matériels de guerre et de matériels assimilés nécessite une autorisation préalable (licence d'exportation et licence de transfert) accordée par le Premier ministre… puis notifiée par le ministre chargé des douanes…

Smalls arms and light weapons (SALW) are subject, depending on their type, to regulation of exports and imports of weapons of war and related items, or to the regulation of firearms.

Remark: For the classification of firearms, refer to Act No. 2012-304 of 6 March 2012 on the Establishment of a Modern, Simplified and Preventive Control of Weapons (and its implementing Decree: Decree No. 2013-700 of 30 July 2013); the Order of June 27, 2012, amended by the Order of March 7, 2013, which sets out the list of weapons of war and related items; and Articles 1 and 2 of Decree No. 2014-62 of January 28, 2014, on Firearms and Ammunition.

1) The rules on export and import of weapons of war, firearms, and ammunition, as well as transfers of products related to defence, are set by the Defence Code, more precisely :
