Artículo 120. Delito de posesión ilegal de armas de fuego, municiones, explosivos y sus accesorios

Cualquier persona natural que sea poseedora o tenedora de un arma de fuego, municiones, explosivos y sus accesorios, así como otros materiales relacionados sin tener la respectiva licencia, comete el delito de posesión ilegal de armas de fuego, municiones, explosivos y sus accesorios, así como los demás materiales relacionados, la que será sancionada a una pena principal de seis a doce meses de privación de libertad, el decomiso del arma y demás artefactos, el pago de una multa equivalente a seis salarios mínimos promedio.

En los casos de las personas jurídicas se les establecerá una multa equivalente a diez salarios mínimos promedio y una carta de amonestación al representante legal con copia al expediente de registro el que servirá de justa causa para una posterior cancelación de la licencia de tenencia o de portación.

Article 120. Crime for Illegal Possession of Firearms, Ammunition, Explosives and their Accessories

Any individual that possesses or is the holder of a firearm, ammunition, explosives, their accessories and other related materials without having the appropriate licence, commits the offence of illegally possessing firearms, ammunition, explosives, accessories, and other related materials. [This offence] shall be punished with a principal penalty of six to twelve months in prison, the confiscation of the firearms and other devices, and the payment of a fine equal to six average minimum wages.

In cases regarding legal persons, a fine of ten average minimum wages shall be imposed, along with a warning letter to the legal representative citing the just cause for the cancellation of the licence for possessing and carrying firearms.
