Article 179

Le décret du 9 novembre 2011 susvisé est ainsi modifié:

1° L'article 1er est remplacé par les dispositions suivantes:
«I. Sont soumis au régime d'autorisation d'importation mentionné au I de l'article L. 2335-1¹ du code de la défense:
«1° Les matériels, armes, munitions et leurs éléments des catégories A,² B³ et C⁴ mentionnés à l'article 2 du décret n° 2013-700 du 30 juillet 2013 portant application de la loi n° 2012-304 du 6 mars 2012 relative à l'établissement d'un contrôle des armes moderne, simplifié et préventif;
«2° Les armes, munitions et leurs éléments du 1° de la catégorie D⁵ et des a, b et c du 2° de la catégorie D du même décret.
«II. Les personnes qui souhaitent procéder à l'importation des matériels mentionnés au I présentent une demande d'autorisation d'importation auprès du ministre chargé des douanes. Les modalités de présentation de cette demande sont définies par arrêté du ministre chargé des douanes.
«III. Lorsque la demande d'autorisation concerne des matériels destinés à être transbordés dans les ports ou les aérodromes de France, elle est établie comme une autorisation de transit mentionnée à l'article 44.»

2° L'article 4 est complété par deux alinéas ainsi rédigés:
«j) Les armes à feu, munitions et leurs éléments à percussion annulaire figurant aux 1°, 2° et 8° de la catégorie C mentionnés à l'article 2 du décret n° 2013-700 du 30 juillet 2013 portant application de la loi n° 2012-304 du 6 mars 2012 relative à l'établissement d'un contrôle des armes moderne, simplifié et préventif;
«h) Les douilles non amorcées et non chargées du c du 1° de la catégorie D et les projectiles des munitions classées en catégorie B, aux 6° et 7° de la catégorie C et en catégorie D du même décret.»;

3° Après l'article 37, le titre III: «Transferts intracommunautaires» est complété par un chapitre VI ainsi rédigé:
«Chapitre VI
«Transferts soumis à une procédure spécifique
«Art. 37-1.-I. En application du V de l'article L. 2335-10 du code de la défense, le transfert à partir d'un autre Etat membre de l'Union européenne vers la France des armes, munitions et leurs éléments des 1° et 2° de la catégorie A2 énumérés à l'article 2 du décret n° 2013-700 du 30 juillet 2013 portant application de la loi n° 2012-304 du 6 mars 2012 relative à l'établissement d'un contrôle des armes moderne, simplifié et préventif est soumis à l'autorisation mentionnée à l'article L. 2335-1 du même code et à ses textes d'application.
«II. Le transfert des armes, munitions et leurs éléments mentionnés au I renvoyés vers la France après exposition ou réparation est dispensé d'autorisation.
«III. Une copie de cette autorisation accompagne les armes, les éléments d'arme, les munitions et les éléments de munition. Ce document doit être présenté à toute réquisition des autorités habilitées.
«Lors de la réception des armes, des munitions et de leurs éléments, le destinataire inscrit leur nature et leur quantité sur la copie de l'autorisation correspondante.»…

Decree No. 2013-700 of 30 July 2013 on the Implementation of the Act No. 2012-304 of 6 March 2012 on the Establishment of a Modern, Simplified and Preventive Control of Weapons

Article 179

The aforementioned Decree of November 9, 2011, is modified as follows:

1° The first article is replaced by the following provisions:
I. [The following] are subject to the import authorisation referred to in I of Article L. 2335-1¹ of the Defence Code:
"1° Materials, firearms, ammunition and their components of categories A,² B³ and C⁴ mentioned in Article 2 of Decree No. 2013-700 of 30 July 2013 on the Implementation of the Act No. 2012-304 of 6 March 2012 on the Establishment of a Modern, Simplified and Preventive Control of Weapons;
"2° Firearms, ammunition and their components of 1° of category D⁵ and of the a), b) and c) of 2° of category D of the same decree.
"II. Individuals wishing to proceed to the import of materials referred to in paragraph I must present a request for an import authorisation before the Minister in charge of Customs. The modalities for the presentation of such request are set by order of the Minister in charge of Customs.
"III. Whenever the authorisation request concerns materials destined to be transshipped in ports or airports of France, it is established as a transit authorisation of the kind mentioned in Article 44."

2° Article 4 is completed by two sub-paragraphs, as follows:
"j) Firearms, rim-fire ammunition and their components listed in the 1°, 2° and 8° of category C mentioned in Article 2 of Decree No. 2013-700 of 30 July 2013 on the Implementation of the Act No. 2012-304 of 6 March 2012 on the Establishment of a Modern, Simplified and Preventive Control of Weapons;
"h) Non-primed and non-loaded cartridges of c) of 1° of category D and bullets for ammunition listed in category B, at the 6° and 7° of category C and category D of the same decree.";

3° After Article 37, title III: "Intra-community transfers" is completed by a Chapter VI, as follows:
"Chapter VI
"Transfers subject to a special procedure
"Art. 37-1.-I. According to the V of Article L. 2335-10 of the Defence Code, the transfer from another Member State of the European Union to France, of firearms, ammunition and their components of 1° and 2° of category A2 listed in Article 2 of Decree No. 2013-700 of 30 July 2013 on the Implementation of the Act No. 2012-304 of 6 March 2012 on the Establishment of a Modern, Simplified and Preventive Control of Weapons, is subject to the authorisation mentioned in Article L. 2335-1 of the same code and to its implementation texts.
"II. The transfer of firearms, ammunition and their components mentioned in I that are sent back to France, after an exhibition or their repair, is exempted from authorisation.
"III. A copy of such authorisation follows the firearms, their components, ammunition and ammunition components. Such document must be presented whenever requested by the competent authorities.
"Upon receiving the firearms, ammunition and their components, the receiver must register their nature and quantity in the copy of the corresponding authorisation."…
