Article 161

I. Le ministre chargé des douanes transmet à chaque Etat membre concerné les informations qu'il recueille en application des articles 149,1 1502 et 152. Il reçoit celles qui lui sont transmises par les autres Etats membres concernant les transferts d'armes, de munitions et de leurs éléments vers la France.

II. Le ministre de l'intérieur transmet à chaque Etat membre concerné les informations relatives aux résidents des autres Etats membres:

1° Qui acquièrent des armes et leurs éléments soumis au régime de droit commun; ou
2° Qui obtiennent une autorisation de détention d'une ou de plusieurs armes ou d'éléments d'arme en France. Il reçoit les mêmes informations des autres Etats membres relatives aux personnes résidant en France.

III. Le ministre de la défense communique aux autres Etats membres et à la Commission:

1° La liste des autorités ou services chargés de transmettre et de recevoir des informations relatives à l'acquisition et à la détention d'armes, de munitions et de leurs éléments;
2° Les listes d'armes, de munitions, et de leurs éléments pour lesquels l'autorisation de transfert d'un territoire à l'autre peut être donnée sans accord préalable ainsi que celles des armes, des munitions et de leurs éléments dont l'acquisition est interdite, soumise à autorisation ou à déclaration.

Il est destinataire des mêmes informations communiquées par les Etats membres.

Decree No. 2013-700 of 30 July 2013 on the Implementation of the Act No. 2012-304 of 6 March 2012 on the Establishment of a Modern, Simplified and Preventive Control of Weapons

Article 161

I. The Minister in charge of Customs communicates to each concerned Member State the information gathered in application of Articles 149,1 150,2 and 152. He receives those communicated by other Member States concerning the transfers of firearms, ammunition and their components, to France.

II. The Minister of the Interior communicates to each concerned Member State the information related to residents of other Member States:

1° Those who purchase firearms and their components subject to common law; or
2° Those who obtain an authorisation to possess one or more firearms, or components of firearms in France. He receives the same information from other Member States related to individuals residing in France.

III. The Minister of Defence communicates to the other Member States and to the Commission:

1° The list of authorities or services in charge of the communication and reception of information on the purchase and possession of firearms, ammunition and their components;
2° The lists of firearms, ammunition and their components for which an authorisation to transfer from one territory to another may be granted without prior consent, as well as those of firearms, ammunition and their components for which the purchase is prohibited, subject to authorisation or to declaration.

He is the recipient of the same information communicated by Member States.
