Artículo 78. Requisitos para la reparación

La reparación de armas de fuego deberá realizarse en talleres autorizados, regentados o supervisados por armeros idóneos. Para estos efectos, las personas naturales o jurídicas titulares de una licencia o certificado vigente de armas de fuego que requieran repararlas deberán presentar al propietario del taller de armería copia simple de la licencia o certificado respectivo, expedido por la DIASP, con su original para cotejo y copia simple de la cédula de identidad personal, junto con el arma de fuego. El dueño del taller de armería estará obligado a llevar un libro de control con el detalle de las armas recibidas para mantenimiento o reparación, con indicación de las generales de sus propietarios.

En caso de que se efectúe la reparación de un arma de fuego que no esté amparada en un certificado de tenencia o licencia de porte de arma de fuego, se procederá a la cancelación del resuelto del taller de armería y al decomiso del arma de fuego, sin perjuicio de la responsabilidad penal para el propietario o el gerente o administrador del taller, por tenencia ilegal de armas.

Article 78. Repair Requirements

Firearms restoration must be conducted in authorised repair shops [armouries], run and supervised by a qualified armourer [gunsmith]. To this end, individuals or legal persons, holders of a valid firearm licence or certificate, wishing to have their firearms repaired, must submit a simple copy of the relevant licence or certificate to the owner of the repair shop issued by DIASP, along with its original for comparison, as well as a simple copy of their personal identity card, along with the firearm. The repair shop owner must keep a control book, with details on all firearms that were received for repair or maintenance, with identification details of their owners.

In case of the restoration of a firearm that is not covered by a firearm possession certificate or a licence to carry firearms, the authorisation of the repair shop [armoury] must be cancelled and the firearm must be seized, without prejudice to the criminal responsibility of the owner, or manager, or administrator of the repair shop [armoury], for illegally possessing firearms.
