Artículo 39. Requerimientos para Comerciantes

Para ejercer sus actividades específicas los comerciantes, importadores, exportadores, consumidores habituales, armadores, transformadores y reparadores de elementos sujetos a control, deberán requerir previamente su inscripción ante la Autoridad Fiscalizadora correspondiente a su domicilio comercial, adjuntando los siguientes documentos:

a) Individualización del solicitante, constitución legal de la persona jurídica y su representante legal.
b) Solicitud del representante legal de la empresa o persona natural en que establezca los rubros que desea inscribir y cantidades a almacenar.
c) Certificado de antecedentes para fines especiales del representante legal y de los socios tratándose de una sociedad de responsabilidad limitada, y del directorio si fuese una sociedad anónima.
d) Antecedentes del lugar de almacenamiento, incluyendo una descripción detallada y croquis a escala del lugar.
e) Fotocopia legalizada de la Patente Municipal al día, o patente minera en el caso de consumidores habituales de explosivos.
f) Fotocopia del RUT. de la empresa…

Este certificado no será necesario para aquellos comerciantes que sólo almacenarán armas.

Para los comerciantes será requisito indispensable contar con dependencias para el almacenamiento, conforme a los requisitos establecidos en el artículo 112.

La Autoridad Fiscalizadora, emitirá un informe a la Dirección General, dando su conformidad y propondrá las cantidades máximas de almacenamiento de cada producto, de acuerdo a lo solicitado por el interesado, el mérito de los antecedentes e inspección realizada.

Article 39. Requirements for Dealers

In order to carry out their activities dealers, importers, exporters, usual clients, gunsmiths and other individuals working on the modification and maintenance of materials subject to control shall first request registration before the corresponding Control Authority of their business place, attaching the following documents:

a) Applicant's identity documents, legal constitution of the legal person and his legal representative.
b) Request of the company's legal representative or individual which establishes the products to be registered and the quantities to be stored.
c) Certificate of the legal representative's criminal records for special purposes, and those of the company's members in case of a company with limited responsibility, or the directory board if an anonymous one.
d) Records of the storage premises, including a detailed description of the latter and its scaled sketch.
e) Certified photocopy of the Municipal Licence, or Mining Licence should the applicant be dealing with explosives.
f) Photocopy of the company's fiscal document…

Such certificate shall not be necessary for dealers only storing firearms.

Dealers are required to have premises for storage in accordance with requirements established in article 112.

The Control Authority shall issue a report to the General Directorate authorising the procedure and fixing the maximum quantities to be stored for each product, in accordance with what is requested by the applicant, the report of the records and the inspection carried out.
