Artículo 74. Transmisión de Armas

El trámite para la transmisión de cualquier tipo de arma de fuego con licencia entre personas naturales y entre estas y las personas jurídicas o entre personas jurídicas, se realiza ante el funcionario competente de la Policía Nacional Revolucionaria, ajustándose a las regulaciones siguientes:

a) El trámite se realiza en la Estación Municipal de la Policía Nacional Revolucionaria correspondiente al domicilio del poseedor del arma de fuego a transmitir.
b) Las armas de fuego objeto de la transmisión, quedan siempre en poder del poseedor, hasta tanto se le conceda la licencia al adquirente.
c) Cuando la transmisión se realice entre poseedores de licencia de una misma clase, al adquirente se le entrega el arma de fuego objeto de la transmisión y copias de las actas de traspaso y custodia, para que proceda al traslado de esa arma hasta la Estación Municipal de la Policía Nacional Revolucionaria donde se controla como poseedor y proceda a tramitar la nueva Licencia de Armas de Fuego.
d) Una vez realizada la transmisión, si el poseedor sólo es titular de licencia para el arma de fuego objeto de la transmisión, le será retirada la licencia.
e) El funcionario competente de la Policía Nacional Revolucionaria que realizó el trámite para la transmisión, comunica sobre su ejecución a la Estación Municipal de la Policía Nacional Revolucionaria receptora, en un término que no exceda las 24 horas de haberse realizado la tramitación.
f) Si la solicitud realizada se deniega, se considera sin efecto la operación realizada.

Article 74. Firearm Transfer

The procedure for the transfer of any type of licensed firearm between individuals, between individuals and legal persons, or between legal persons, shall be carried out before the competent official of the National Revolutionary Police, in accordance with the following requirements:

a) The procedure shall be carried out in the Municipal Station of the National Revolutionary Police corresponding to the residence of the owner of the firearm to be transferred [seller].
b) Firearms subject to the transfer remain in possession of the owner [seller], until a licence is issued to the buyer.
c) When the transfer is carried out between individuals possessing a licence of the same class, the transferred firearm is handed over to the buyer, as well as copies of the minutes of the transfer and custody documents, so that he may then present the firearm to the Municipal Station of the National Revolutionary Police where he is registered as the licensed owner and where the new Firearm Licence shall be issued.
d) Once the transfer has been finalised, if the owner's licence [licence of the seller] applied only to the transferred firearm, the licence shall be revoked.
e) The competent official of the National Revolutionary Police that carried out the transfer procedure shall report it to the corresponding Municipal Station of the National Revolutionary Police, within 24 hours after the transfer has been carried out.
f) If the request is rejected, the operation shall be considered invalid.
