Artículo 21. Fábricas y Talleres

En desarrollo del artículo 59 del Decreto 2535 de 1993, para el funcionamiento en el territorio nacional de fábricas de artículos pirotécnicos, pólvora negra, perdigones, fulminantes y talleres para reparación de armas, se expedirá el respectivo permiso previo el lleno de los siguientes requisitos:…

b) Para el permiso de funcionamiento de Talleres de Armería, se requiere:
1. Solicitud motivada dirigida al Comandante General de las Fuerzas Militares, con los siguientes datos:
a) Nombre, apellidos completos, número de cédula de ciudadanía y dirección del solicitante.
b) Localización del taller.
2. Certificado judicial nacional vigente del solicitante.
3. Estudio de seguridad de las instalaciones y del personal, por parte de la autoridad militar de su residencia.
4. Acreditar la experiencia en el manejo y fabricación de pólvora y de artículos pirotécnicos.
5. Certificación que acredite al personal, como idóneo en la fabricación de artículos pirotécnicos, o en su defecto presentar un examen de competencia ante la Junta Técnica que para el efecto designe el Departamento de Control Comercio Armas, Municiones y Explosivos del Comando General de las Fuerzas Militares.
6. Certificado de seguridad, expedido por el Cuerpo de Bomberos.
7. Carátula del producto, aprobado por el Ministerio de Salud Pública.
8. Concepto de la autoridad civil sobre conveniencia o inconveniencia de la instalación de la fábrica.

b) Para el permiso de funcionamiento de Talleres de Armería, se requiere:…
5. Apertura de un libro, foliado y registrado en el Departamento Control, Comercio Armas, Municiones y Explosivos del Comando General de las Fuerzas Militares. Este libro será revisado en los cinco primeros días de cada mes por la autoridad militar de su residencia…

Parágrafo. El permiso de funcionamiento de los Talleres de Armería y Fábricas de Artículos Pirotécnicos, tendrá validez por tres años a partir de la fecha en que se otorgue. La revalidación del permiso de funcionamiento se sujetará a los requisitos previstos en el presente artículo.

Article 21. Factories and Workshops

Under article 59 of Decree 2535 of 1993, a permit shall be issued in order to run, within the national territory, factories of pyrotechnic material, black powder, pellets, detonators, and workshops for the repair of firearms, subject to prior compliance with the following requirements:…

b) For operating gun-shops [armouries]:
1. A motivated application submitted to the General Commander of the Military Forces with the following information:
a. Name, full surnames, ID number and address of the applicant.
b. Location of the workshop.
2. The valid National Certificate of the applicant.
3. Assessment of the security measures of the facilities and the personnel, carried out by the military authorities of his residence.
4. Evidence of the experience in the handling and manufacturing of gunpowder and pyrotechnic articles.
5. Certificate demonstrating the applicant's personal ability to manufacture pyrotechnic articles, or, failing this, undergo a competency test before the Technical Commission instructed by the Department for the Control on the Commerce of Firearms, Ammunition and Explosives of the General Command of the Military Forces.
6. Security certificate, issued by the Firemen forces.
7. Cover of the product, approved by the Ministry of Public Health.
8. Assessment by the Civil Authority of the convenience and risks of the setting up of the factory.

5. Keep a register, numbered and registered at the Department for the Control on the Commerce of firearms, Ammunition and Explosives of the General Command of the Military Forces. The book shall be revised the first five days of each month by the military authority of his residence…

Paragraph: The permit to operate gun shops [armouries] and factories for pyrotechnic materials shall be valid for three years starting from the date of issuance. The renewal of the permit is subject to requirements referred to in this Article.
