Artículo 1. Indicaciones Jurídicas

Será sometido judicialmente, por aplicación de los artículos 39 y siguientes de la Ley 36, Sobre Comercio, Porte y Tenencia de Armas de Fuego "toda persona que fabrique, reciba, compre o adquiera de cualquier modo, tenga en su poder o bajo su custodia, venda o disponga en cualquier forma, porte o use de cualquier manera, armas de fuego, o rifles de aire comprimido, sus piezas o partes sueltas y municiones y fulminantes para las mismas, en contravención a las disposiciones de la presente ley…", exceptuando, por aplicación del Párrafo V de ese artículo 39, las personas autorizadas por la Secretaría de Estado de Interior y Policía; en este mismo sentido por aplicación del artículo 43, modificado por la Ley 589 del 2 de julio de 1970, serán condenados con pena de diez (10) a veinte (20) años "…a toda persona que recorte o haga recortar carabinas, escopetas, rifles y cualquier otra clase de armas de fuego; o que coopere en tales operaciones o proporcione los medios para ejecutarlas, caso que tuviere en su poder, oculte o conduzca armas así modificadas; o que de manera general haya facilitado o ayudado a la comisión de este crimen"…

Resolution 02-06, on Provisions for the Application of the Control of Firearms

Article 1. Judicial Provisions

'Any individual who manufactures, receives, purchases or acquires in any way, having under his control or custody, sells or provides in any way, carries or uses in any way, firearms, air-rifles, their pieces or loose parts and ammunition and detonators for the latter, in violation of provisions of the present Act' shall be prosecuted, as provided by article 39 and following of the Act 36, on Commerce, Carrying and Possession of Firearms; except for persons authorised by the Ministry of the Interior and Police, as provided by paragraph V of Article 39; furthermore and as provided by article 43, modified by the Act 589 of July 2 1970, 'any individual who shortens carbines, shotguns, rifles and any other type of firearm – or has them shortened, or takes part in their modification or provides the means for this to be carried out, or is found with firearms that were modified in this way, hides them or carries them, or facilitates, in any way, the commission of this crime' shall be sentenced with a prison term between ten (10) to twenty (20) years…
